Relaxation on Additional Fees being Levied under Companies Act, 2013 and LLP Act, 2008
Introduction:
MCA has relaxed additional fees on certain forms under the Companies Act, 2013 and LLP Act, 2008 vide General Circular No. 06/2021 dated 03/05/2021.
This comes in the wake of Current Pandemic Covid-19 situation in the country.
Applicability:
Every form of Companies Act, 2013 and LLP Act, 2008 but other than Charge Form (CHG-1, CHG-4 and CHG-9) has been covered under this relaxation.
Further Charges forms are relaxed with slightly different rules vide General Circular no. 07/2021
Interestingly Form SH-7 has also been covered under this relaxation unlike CFSS Scheme, 2020.
Period:
It is important to understand the period of relaxation here.
As of now only those forms will be covered under this relaxation whose due date falls between 01/04/2021 to 31/05/2021 and filing without additional fees will be allowed upto 31st July, 2021 for such forms.
For Eg.
- Form MGT-14 (to be filed within 30 days of passing of resolution)
- Resolution Date – 15/03/2021
- Due date of Filing Form MGT-14- 13/04/2021
Here the due date is falling under the prescribed period of 01/04/2021-31/05/2021 hence additional fees will not be levied till 31/07/2021.
- Form MGT-14 (to be filed within 30 days of passing of resolution)
- Resolution Date- 15/05/2021
- Due date of Filing Form MGT-14-13/06/2021
Here the due date is falling beyond the prescribed period of 01/04/2021-31/05/2021 hence additional fees will be applicable as per the current general circular.
