In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II- Section 3 – Sub- section (ii) vide S.O No. 283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in the Handbook of Procedures (Vol.1) (RE-2001), 1997-2002.
Attention is invited to Paragraph 4.11 of the Export and Import Policy 1997-2002, as amended and Paragraphs 7.8 and 7.10 of the Handbook of Procedures, Vol.1, 1997-2002, as amended and also to the Handbook of Procedures, Vol.2, 1997-2002, as amended from time to time.
Attention is invited to the entry at Code No. 1001(b) in Table B of Schedule 2 and Sr. No. 12(ii) of Appendix –1 to Schedule 2 in the book titled “ ITC(HS) Classifications of Export and Import Items, 1997-2002 ” (incorporating amendments made upto 31st August, 1998) and as amended from time to time specifying the terms and conditions for export of items indicated therein.
In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, the Director General of Foreign Trade hereby makes the following amendment to the Public Notice No. 14(PN)/97-2002 dated 06.06.1997, namely.
The issue was considered by the Policy Review Committee at its meeting held on 13.08.2001 under the chairmanship of DG. In view of the decision taken therein, it is clarified that the licence holders availing this facility are also required to maintain average export obligation during the extended period till the export obligation is completed in full. For example, if the licence was issued during 1993-94 period.
The Indian Sugar and General Industry Export Import Corporation Ltd., (ISGIEIC Ltd.), now known as Indian Sugar Exim Corporation Ltd., shall be sole agency authorized to export white sugar to EEC against the preferential Quota as indicated above.
In this regard, and in continuation to policy circular no. 3(RE-2001)/1997-2002 dated 07.06.2001 and policy circular no. 5(RE-2001)/1997-2002 dated 20.07.2001, it is hereby further clarified that the condition on import of textile and textile articles as per the aforementioned notification, shall not be applicable on imports made under provisions at paragraph 5.40 of Handbook of Procedures, Vol.I, 1997-2002 (incorporating amendments made upto 31.03.2001) and on imports made as per conditions at Sl. No. 130 of Notification no. 17/2001-customs dated 01.03.2001.
In case of blended Textiles, if the fibre content of one type is more than 95%, the DEPB rate of the blended item would be the same as that of the particular fibre. However if no fibre constitutes 95% or more of the blend, the DEPB rate would be the lowest amongst the different fibres ignoring those with less than 5% in the blend. DEPB rates would not be denied to composite items provided the value of the extra material is upto 5% of the total value and a DEPB rate exists for the fibre comprising a value of 95% or more of the composite.
The import of vehicles (as classified under Chapter 87 of ITC(HS) Classifications of Export and Import Items, 1997-2002 ) by Foreign Diplomats and Other Privileged Persons in this category, who are exempt from payment of customs duty,shall be exempt from all the conditions of Notification no. 4(RE-2001)/97-02 dated 31.03.2001. However, such imported vehicles cannot be sold in India except to another diplomat or privileged person and are compulsorily required to be re-exported. This exemption shall be applicable on all imports made subsequent to 31.03.2001.
In respect of Notification No. 20 (RE-2001)/1997-2002 dated the 27th July, 2001, extending the shipment period for export of onions released vide Notification No.16(RE-2001)/1997-2002 dated 26th June,2001 upto 31st August,2001, it has been decided to further extend the shipment period for export of the unutilized balance quantity of onions out of the 50,000 M.T., released vide aforesaid Notification No.16, upto 30th September,2001.
