The Bombay HC last week quashed the decision of the Customs, Excise, Service Tax Appellate Tribunal which held the Director General of Foreign Trade (DGFT), the licensing authority under the Foreign Trade (Development & Regulation) Act, did not have the powers to amend licences with retrospective effect. The CESTAT ruling was challenged by Bhilwara Spinners Ltd, manufacturers of yarn, which were granted ‘export promotion capital goods’ licence to import capital goods. The terms had to be changed due to market circumstances.

Notification No 34(RE – 2010)/2009-2014,- The government has slashed the minimum export price (MEP) of onion for the third time this month to USD 275 per tonne from the earlier price of USD 350 per tonne. “MEP of onions other than Bangalore Rose Onions and Krishnapuram onions will be USD 275 per metric tonne FOB (freight-on-board),” the Directorate General of Foreign Trade said in a notification.
The Director General of Foreign Trade (DGFT) would be available for interaction between 3.00 PM and 5.00PM on Friday, 18th March 2011 at room number 4, Ground Floor, H Wing, Udyog Bhawan (Conference Room of DGFT). Entry is through Gate No.2 of Udyog Bhawan.
The Bombay high court last week quashed the office memorandum / press release dated November 11 and policy circular dated December 22 last year as they were not issued under the provisions of the Foreign Trade (Development and Regulation) Act, and, therefore, the restrictions contained in them were contrary to law.
All other provisions of the Notification No. 33/2009-14 dated 03.03.2010, shall remain unchanged, and shall continue to apply. The above amendments are not applicable for export of 20,000 MT of rice(Ponni Samba) to Sri Lanka through PEC.
The export of cotton is free subject to registration of export contracts with DGFT. The cap on export during the Cotton Season, 2010-11 (01.10.2010 to 30.09.2011) will be 55 lakh bales or as notified by DGFT from time to time. But, export of 5,000 bales of Assam Comillas Cotton (Tariff Code 5201 00 12) is exempted from the cap, but not from registration.
Existing fee for issuance of Certificate of Origin (Preferential) is Rs. 150/- (Rupees One Hundred and Fifty only). This fee is enhanced to Rs. 350/- (Rupees Three Hundred and Fifty only) from 1st April, 2011.
The export of cotton yarn (Tariff Codes 5205, 5206 & 5207) was allowed under licence. Now, issue of export licences for cotton yarn will be subject to a limit of 720 million Kgs during the fiscal year 2010-11 (i.e. upto 31.03.2011).
All conditions in policy circular no 15 of 1st February 2011 will continue to apply, except the specification about dates and the calendar given in Annexure 2 thereof since the allocation is being made today (10th March 2011 and not on 10th February 2011). Special attention be paid to para 3(iv) & (v).
