Due to extensive changes in the systems during the roll out of GST, and ensuring that there is no delay in clearance of such goods due to system issues following decisions have been taken :
Attention of all officers posted in the CFSs for clearance of the export cargo is invited to the Board Circular Nos. 34/95, dated 06.04.1995; 1/2011-Customs, dated 04.01.2011; along with the S.O. No. 41/2007, dated 10.10.2007; 42 /2011, dated 13.05.2011; and Standing Order No.17/2009, dated 21.04.2009; as amended vide Standing Orders No. 10/2010, dated 11.02.2011; 06/2011, dated 19.01.2011; and 12/2014, dated 17.12.2014 in respect of procedure for drawing of samples and testing. Recently, many instances have been noticed, wherein above instructions were not followed.
Procedure for amendment/conversion of free shipping bills to Export Promotion shipping bills and amendment/conversion of shipping bills from one scheme to another scheme-
Central Government hereby makes the following amendments in Notification No. 37/2015-2020 dated 27.01.2017 on (Export policy of Sandalwood oil at Sr. No. 185, Chapter 44 of ITC(HS) Classification – Schdule 2 (Export Policy), with immediate effect:
If such Bill of Entry is not assessed on priority, for any reason thereof, within 06 hours of the request made, then the concerned Group AC/DC should place such Bill of Entry details before the concerned ADC/JC for taking necessary action in the matter. Further, even if, assessment of such Bill of Entry is not resolved at the level of concerned ADC/JC on the same working day, then the matter should be immediately brought to the notice of concerned Commissioner for necessary action. A databank with regard to such request received in the Group/s should also be maintained.
The MEIS benefit for export of ‘Onions Fresh or Chilled’ under ITC (HS) code 07031010 is extended up to 30.09.2017 vide Public Notice 10/2015-2020
M/s International Gemological Institute (India) Pvt Ltd, Bandra Kurla Complex, Mumbai is added as agency permitted to import duty free diamonds for certification/grading and subsequent re-export, subject to conditions mentioned in paragraph 4.75 of Handbook of Procedures 2015-20 and other applicable provisions of the law in this regard.
Accordingly, it has been decided that any request received from the DPD Importer by the concerned Group AC/DC, either through letter or SMS/whatsapp at their mobile numbers listed on JNCH website or by email at appraisingmain.jnch@gov.in should be attended by the concerned Group immediately.
Important FTP provisions in the context of the implementation of the GST regime applicable w .e.f. 01.07.2017. The chapter wise provisions of the FTP 2015-20:
DGFT exists as on date & the DGFT is the policymaker & Customs simply an implementer. However, under the new GST regime, there seems that the authority of the DGFT is totally undermined as if that authority does not exist anymore. However, it appears that the DGFT in itself has brought upon them this situation.
