Market regulator Securities and Exchange Board of India (SEBI) is considering allowing companies to allocate the unused quota in public offers exclusively to retail investors. The move is expected to further increase retail participation in government offers where the employee quota is usually undersubscribed while retail is oversold because of good pricing. “A proposal is under examination,” a SEBI official told ET.
Under flak for the new Internet rules which are being interpreted as an attack on privacy of a user, the government while clarifying the rules questioned the why critics were silent when the draft rules were opened for public opinion. R Chandrashekhar, Secretary in the Department of Information Technology, in an interaction with PTI said views from all stakeholders were taken and the best practices prevalent globally were incorporated in the new rules.
The Central Board of Direct Taxes (CBDT) will continue to enjoy the power of telephone tapping despite a strong recommendation by a Committee of Secretaries against it following a controversy in the wake of the Niira Radia episode. “The CBDT will continue to have the power of phone tapping subject to certain conditions,” an official said.
The Shamshabad airport police here have registered a case of extortion against two inspectors of the Customs department after a woman passenger accused them of demanding bribe from her, police said today. The woman, who landed at Rajiv Gandhi International Airport (Shamshabad) from Dubai yesterday, lodged a complaint with the police alleging that the two inspectors, identified as Vinod Kumar and Ali Khan, of the Customs demanded Rs 7,000 from her as ‘fine’ to allow her to take a gold ornament of 50 gm that she was carrying in her bag.
In the backdrop of banks’, including State Bank of India’s, rising non-performing assets, Finance Minister Pranab Mukherjee today said their asset quality is a matter of concern. Recently ITAT Mumbai in the case of Standard Chartered Bank (Taxpayer) (ITA No. 3827/ MUM/ 2006) on the issue whether data processing charges paid by the Taxpayer would constitute ‘royalty’ under the Indian Tax Laws (ITL) and the India – Singapore Tax Treaty (Tax Treaty) held that the payments were made for use of a facility and not any process. Furthermore, in the absence of control or physical access to any equipment, it cannot be said that the payment was made for any use or right to use the equipment. Hence, payment would not amount to ‘royalty’ under the ITL and the Tax Treaty and would be business income not chargeable to tax in absence of PE.
