Sub: Representation for Quick disposal of covered appeals etc. in ITAT

At the outset we congratulate Your honour on your taking over the charge as president of ITAT. We take this opportunity to make the following suggestions for improving the service by Hon’ble ITAT to tax payers:

1. Disposal of covered cases on priority basis by fixing them for hearing: At present appeals are fixed in routine and may take one to two years period even for first hearing. it is humbly submitted that there should be priority disposal of the following categories of cases so that disposal can be fast and pendency can be reduced:

a) Cases covered by decisions of Hon’ble Supreme Court and High Courts

b) Penalty cases where quantum has already been deleted.

c) Single point set aside cases

d) Cases where opportunity was not given and is to be sent back to lower authority.

e) Cases involving appeals of senior citizens

f) Cases of widows.

This would do away with the requirement of filing stay petition in such cases which would ultimately reduce workload of Hon’ble ITAT.

2. Suggested procedure:

The party to litigation whether petitioner or respondent should make an application that his cases deserve priority disposal. With the application he should attach copy of other case on the basis of which his case is covered. Copy should be given to other party. Then such case may be fixed on next Friday. Adjournment, if any, should be short upto next Friday.

This way the justice would be quick. Pendency would reduce substantially. One Bench can dispose more than 10 appeals each Friday. Pendency in whole country should reduce at least by about 10000 per year.

3. The Assessee as well as Advocates, CA, and DR would be happy to get quick justice and timely disposal. Hon’bleFinance Minister, Law minister and law Secretary would be happy to see reduction in pendency. Department would get reduction in frivolous demand. Overall it would benefit all.
