PUBLIC NOTICE NO. 44 (RE-01)/ 1997-2002

NEW DELHI, the  31st   October ,2001

In exercise of  powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II Section 3, Sub section (ii) vide S.O. No.283(E) dated 31.03.1997, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol 1).(RE-01), 1997-2002.

1)    A new proviso  is added  at the end of para 7.51 pertaining to the “time period for filing of application in the case of  loss of a DEPB shipping bill” as under:

Provided however that if a provisionally assessed  DEPB shipping bill is lost , the time period for filing of application for DEPB would be 180 days from the date of release/ final assessment of the shipping bill.

2)    An amendment is made to “ Documents to be enclosed with the application form” under Appendix 19 B pertaining to “ Application for Grant of SEH, ISEH, ISSEH, ISSSEH” as under

Documents to be enclosed with the application form:

1. Self certified copy of a) project approval or b) classification approval of the Department of Tourism or c) any other registration (in the case of the hotel industry, an RCMC from FIEO is acceptable)

2. A certificate from Chartered Accountant/ Cost and Works Accountant certifying the export/ import performance in the prescribed format.

3. Self declaration regarding irrevocable option to claim the benefit either on gross value of foreign exchange earnings, direct and indirect sources, FOB or on NFE, direct and indirect sources basis.

4. Copy of the FIRC issued by the Bank in respect of foreign exchange received for service rendered. However this would not be applicable to the Hotel Industry.

5. Copy of the balance sheet filed with the Income Tax Authorities for the relevant year/CA certificate from the statutory authorities

3)    The following amendments/ corrections shall be made in Appendix 28 A which pertains to the DEPB rate list

(i)  Product Group – Engineering (Product  Code No 61)

(a) The following entries are amended as under:
