You are requested to direct the Principal Commissioners/ Commissioners under your jurisdiction to not transfer/amend the authorization without the express approval of the Board. It is reiterated that all Petitions, specifically GST related petitions, should be efficaciously defended by the authorized Commissioners. The contents of this Instruction may also be bought to the notice of concerned field formations under your jurisdiction.
Assam joined the list of States that have rolled out the e-way bill system for intra-State movement of goods on 16th May, 2018. Rajasthan would be doing the same on 20th May, 2018 thereby taking the number of States / Union Territories that would have rolled out the e-way bill for intra-State movement of goods to twenty. Further, as you all know intra-State movement of goods would be implemented throughout the country by 3rd June, 2018.
In exercise of the powers conferred by Section 35R of the Central Excise Act, 1944 made applicable to Service Tax vide Section 83 of the Finance Act, 1994 the Central Board of Indirect Taxes fixes a monetary limit of Rs 2,50,000/- below which appeal shall not be filed with the Commissioner (A).
A number of steps have been taken which has resulted in the reduction of the total pendencies of cases at the level of Commissioner (Appeals) and CESTAT. Firstly action plan was put in place to liquidate pendencies at the level of Commissioner (Appeals).
ITBA is designed as a comprehensive platform in which all the processes of Department can be completed online in the System. For performing any action on any proceeding in system, a key pre-requisite that the base order of the proceeding should exist in the system.
During the period of 1st to 15th June, 2018, all assessing officers shall accord top priority to work of giving appeal effect and passing the rectification orders, and shall earmark the first half of the day to meet applicants/ counsels who seek to have a hearing to explain their case.
I would also urge the officers to expedite the process of approval of GST Practitioners. A proactive approach in facilitating the enrolment and helping the applicants, in case they have committed any bona fide mistakes while making application, will only further our cause of achieving a trade-friendly image for the department.
