Quick Summary

When to use which ITR form??

ITR 1 (Sahaj) – For Individuals being a Resident (other than Not Ordinarily Resident) having Total Income upto Rs.50 lakhs, having Income from Salaries, One House Property, Other Sources (Interest etc.), and Agricultural Income upto Rs.5 thousand (Not for an Individual who is either Director in a company or has invested in Unlisted Equity Shares)

ITR 2 – For Individuals and HUFs not having income from profits and gains of business or profession

ITR 3 – For individuals and HUFs having income from profits and gains of business or profession

ITR 4 (Sugam) – For Individuals, HUFs and Firms (other than LLP) being a Resident having Total Income upto Rs.50 lakhs and having income from Business and Profession which is computed under sections 44AD, 44ADA or 44AE (Not for an Individual who is either Director in a company or has invested in Unlisted Equity Shares)

ITR 5 – For persons other than: –

(i) Individual,

(ii) HUF,

(iii) Company and

(iv) Person filing Form ITR-7

ITR 6 – For Companies other than companies claiming exemption under section 11

ITR 7 – For persons including companies required to furnish return under sections 139(4A) or 139(4B) or 139(4C) or 139(4D)

Compulsory E-filing w.e.f. AY 2019-20 except only individuals with age > 80 years can now file paper return for ITR-1 (Sahaj) & ITR-4 (Sugam)

Eligibility of ITR Forms

Forms Who is eligible to file this form Who is not eligible to file this form
ITR-1 (Sahaj) For Individuals being a Resident (other than Not Ordinarily Resident) having

  • Total Income upto Rs.50,00,000 from Salaries/Pension; or One House Property; or Other Sources (Interest etc.),

and

  • Agricultural Income upto Rs.5,000.
Not for an Individual who: –

1. is a Director in a company;

2. has invested in Unlisted Equity Shares;

3. has any asset (including financial interest in any entity) located outside India;

4. has signing authority in any account located outside India; or

5. has income from any source outside India.

6. Having income from PGBP, Capital gains, more than 1 house property, winnings from lottery; activity of owning and maintaining race horses; income taxable at special rates under section 115BBDA or section 115BBE; or income to be apportioned in accordance with provisions of section 5A.

7. has any b/f or c/f of loss u/h house property, loss u/h other sources, any claim of relief u/s 90 and/or 91; any claim of deduction u/s 57, other than deduction under clause (iia) thereof (relating to family pension); or any claim of credit of TDS in the hands of any other person.

8. is a resident not ordinarily resident (RNOR) and non-resident.

ITR-2 For Individuals and HUFs not having income from PGBP and who is not eligible for Form ITR-1 (Sahaj) Not for an Individual Having income from PGBP
ITR-3 For individuals and HUFs having income from PGBP and who is not eligible to file Form ITR-1 (Sahaj), ITR-2 or ITR-4 (Sugam).
ITR-4 For Individuals, HUFs and Firms (other than LLP) being a Resident having Total Income upto Rs.50 lakhs and having income from PGBP which is computed under sections 44AD (i.e. Gross Turnover upto Rs. 2 crore); 44ADA (i.e. Gross receipt upto Rs. 50 lakh); or 44AE (income from goods carriage upto ten vehicles); or Salaries/Pension; or One House Property; or Other Sources (Interest etc.), and Agricultural Income upto Rs.5,000. Not for an Individual who: –

1. is a Director in a company;

2. has invested in Unlisted Equity Shares;

3. has any asset (including financial interest in any entity) located outside India;

4. has signing authority in any account located outside India; or

5. has income from any source outside India.

6. Having income from speculative business, agency business, commission or brokerage income etc. i.e. not required to be computed u/s 44AD, 44ADA or 44AE; Capital gains, more than 1 house property, winnings from lottery; activity of owning and maintaining race horses; income taxable at special rates under section 115BBDA or section 115BBE; or income to be apportioned in accordance with provisions of section 5A.

7. has any b/f or c/f of loss u/h house property, loss u/h other sources, any claim of relief u/s 90 and/or 91; any claim of deduction u/s 57, other than deduction under clause (iia) thereof (relating to family pension); or any claim of credit of TDS in the hands of any other person.

8. Total Income exceeds Rs.50 lakhs

9. having income from PGBP which is computed under sections 44AD (i.e. Gross Turnover exceeds Rs. 2 crore); 44ADA (i.e. Gross receipt exceeds Rs. 50 lakh); or 44AE (income from goods carriage exceeds ten vehicles);

ITR-5 For Firm, LLP, AOP, BOI, AJP referred to in Section 2(31)(vii), local authority referred to in Section 2(31)(vi), representative assessee referred to in Section 160(1)(iii) or (iv), cooperative society, society registered under Societies Registration Act, 1860 or under any other law of any State, trust other than trusts eligible to file Form ITR-7, estate of deceased person, estate of an insolvent, business trust referred to in section 139(4E) and investments fund referred to in section 139(4F). For persons: –

(i) Individual,

(ii) HUF,

(iii) Company and

(iv) Person filing Form ITR-7

ITR-6 For Companies other than companies claiming exemption under section 11
ITR-7 For persons including companies required to furnish return under sections 139(4A) or 139(4B) or 139(4C) or 139(4D)

    WHICH ITR FORM TO ADOPT FOR FILING ITR A Y 2020-21 IF and individual having salary income from partnership firm , intererst and profits from partnership firm
