CA Sandeep Kanoi

Pursuant to Writ petitions filed by Delhi Chartered Accountants Society & All India Chartered Accountants Forum in Delhi High Court, HC Court has directed to form a committee comprising of Mrs. Prem Lata Bansal, Sr. Adv, CA. Swadesh Gupta and 2 members from ICAI to represent before CBDT and come up with a mutual solution on 21.10.2013. Pursuant to direction an meeting was held and following is the extract of the meeting discussions :- 1) Committee met with CBDT and sought one month extension from CBDT.

2) CBDT did not agree with the proposal in the meeting and said that they will communicate the final decision.

3) Next hearing at Delhi High Court is on 24th.

    The only reason why the CBDT is being adamant on non-extension the way i see it is to ensure that all the self assessment taxes are paid within the half year closing. Dosent seem to me that there is any other justifiable reason.

    Extending the due date of filing Tax audit reports, and denying extension to file ITR’s is a contradiction in itself! Consultants, professionals, business houses and now multiple High Court’s have requested / directed CBDT to extend the filing date. Just doesnt seem to go good with them.

    Perhaps FM has given the ITD a stern target of tax collections by 30/09/14!!! Wish they clear their stand in the next two days at least.

    This reminds a cartoon appeared some time back:” File, smile and go and don’t argue” and also an article by the great lawyer Shri Nani Palkhiwala wherein he has mentioned “Let us never forget the wise words of Justice Hughes who observed that no democracy can survive without respect for laws and institutions, but that in a free democracy laws and institutions will command that degree of respect which they deserve”. So let us wait and see how our Delhi High Court proceeds in this issue.

    dear sir,

    CBDT is adament. What will happen in following situations:
    1. I try upto 8 p.m. on 30/09/13 and I could not upload audit report. Do I have time to file the hard copy. My business is situated in a Taluka Office and IT office is situated in the District place about 60 -100 km away.
    2. I have loss under CG and there is TI of above Rs. 5 lakhs. I have to file return by 30th Sept. I try upto 30th Sept 2013 upto 8 pm. I could not upload due to slow Web site of IT dept. I am deprived from claiming carry forward of loss under CG.
    During July 2013 the web site was down/slow from 23rd July upto 5th Aug. The time extended upto 5th Aug was also of no use.

    CBDT should have human approach. The high court of Delhi ought to have decided the matter. What was point in deputing a committee for discussion with CBDT.
