An all-India drive from 16th May 2023 to 15th July 2023 against the fake GST Registration is already begin and the department started taking various actions against the taxpayers who found to be violating the rules of GST in relation to registration, principal place of business, record keeping and maintaining of actual records. In this article, we will look from the perspective of the GST officer to avoid the penalty and penal actions against our business and how businesses can be prepared during a GST Department visit.

During this special drive The Goods and Services Tax Network (GSTN) will identify potentially fraudulent GST Identification Numbers (GSTINs) for both State and Central Tax authorities. The GSTN will share specific information about these suspicious GSTINs, categorized by jurisdiction, with the relevant State/Central Tax administration. This will enable them to conduct thorough verifications and take appropriate action as necessary. If, upon detailed verification, it is determined that the taxpayer does not exist and is fictitious, the registration of the taxpayer in question will be suspended or cancelled.

Primary Purpose of the Visit:

When the GST Department pays a physical visit to your business premises, their primary objective is to verify the presence of principal place of business on the address mentioned during registration or on the address updated later on. Further, they will verify the accuracy and completeness of your GST records in order to ensure that your business is complying with all applicable GST laws, including proper registration, filing of returns, and payment of taxes.

What to Expect:

During the GST Department visit, expect authorized officers to conduct an inspection of your business premises.

They may request access to various areas, such as your office, warehouse, production facilities, or any other relevant location. The officers will scrutinize records, invoices, purchase and sales registers, ledgers, stock registers, and other relevant documents to validate the accuracy of the reported information.

  • Size and Format: While there are no specific guidelines on the size and format of the display board, it is recommended to use a size that ensures easy readability. The format can vary, but it should include the business name, GSTIN, and any other relevant information.

2. GST Registration Certificate:

  • Visible Display: The GST registration certificate should be visibly displayed at the registered place of business, such as an office or retail store. It should be easily accessible for verification purposes.
  • Legibility: The information on the certificate, including the business name, GSTIN, registration date, and other details, should be clear and legible.
  • Authenticity: The certificate should be an original document issued by the appropriate tax authority and should not be tampered with or altered in any way.
  • Validity: Ensure that the displayed registration certificate is valid and up to date.

3. Organize Your Documentation:

Ensure that all your GST-related documents, such as Sale or Purchase invoices & registers and tax payment records, are well-organized and easily accessible. Keeping accurate and up-to-date records will demonstrate your commitment to compliance.

4. Review Your GST Compliance: Conduct an internal audit to review your GST compliance procedures, including registration, copy of the previous returns filed, and details of the tax payments. Address any identified gaps or errors before the visit to avoid potential penalties or further scrutiny.
