Dear Smt Nirmala Ji,

Sub : Issues and concerns of trading community on GST

Your good self is aware that the Confederation of All India Traders (CAIT) was the first Organisation in the Country which supported the Goods & Services Tax in the Country and on the instance of the then Hon’ble Minister for Finance Late Shri Arun Jaitley, conducted a massive awareness campaign about GST among the business community across the Country. It is a matter of record that the CAIT hold about 400 Conferences and Seminars etc. The role of CAIT was equally lauded by Hon’ble Prime Minister Shri Narendra Modi and Late Shri Arun Jaitley and even by your good self also many times.

However, we wish to bring it to your kind and immediate knowledge that across Country, the tax officials in different states are using coercive methods against general traders and while harassing and victimising them on one pretext or the other after armed with arbitrary and unfettered powers by virtue of several recent amendments made in GST rules thereby creating an atmosphere of tax terrorism much against the declared mandate of Hon’ble Prime Minister Shri Narendra Modi, has further created a feeling of fear among the traders across Country.

We would like to express our firm view that tax offenders and tax avoidance must be dealt with strict actions but under the garb of such powers, the honest and law abiding traders should not be punished. We are of the considered view that the tax net under GST should be widen and revenue for both Union & State Government should be augmented but it can happen only when the GST taxation system is simplified and rationalised to the extent that even a small traders conducting business activities in remote area should be able to compliance the law in a most easiest way.

We are enclosing a detailed memorandum of few important and burning issues of GST for your kind consideration and their effective resolution at the earliest. We would like to mention that in this context a meeting was held on 22nd Fcbruary,2021 between CAIT and senior officials including Learned the then Finance Secretary Shri Ajay Bhushan Oandey, CBIC Chairman Shri M Ajit Kumar, CBDT Chairman Shri P C Mody and other officials. We appreciate the progressive approach of the Government and learned officials also understood the concerns of CAIT.

We shall be grateful if you kindly accord us an earliest convenient appointment to discus the issues and complications.

    I have come cross few suppliers running away from business after collecting payment for their supplies along with taxes and at the same time the suppliers
    not filing their GST returns. Now departments sending notices stating the difference between ITC availed in Gstr3B and ITC reflected in GSTR2A. The department wanted us to pay the amount not
    reflected in GSTR2A along with penalty and interest. The business community gets around 5 to 10% profit margin. Due to not filing of GSTR by the
    suppliers and also not remitting the taxes collected from the business community to the Govt Exchequer, the honest return filers with payment are further burdened with this demand by tax authorities to pay the difference between ITC availed and ITC reflected in GSTR2A. This action
    by Govt causing worry, because our capital being
    eroded,
    I suggest GST Council should make amendment in
    such a way that while releasing payment to suppliers the buyer should split the payment into two Parts. First the tax part and buyer should
    pay directly to GST excequer mentioning GSTIN of the supplier and the second part the remaining amount after deducting the tax to the supplier. This
    method will safeguard the interests of the genuine
    business people and at the same time Govt income
    also protected. Subsequently Govt can take stringent action against defaulters for not filing the GST Returns. This method saves lot of time and unnecessary harassment by authorities issuing notices and demanding explanation. Govt can take
    action for not filing the returns by the defaulters separately

    MICRO BUSINESSES, WHICH GENERATE MORE EMPLOYMENTS THAN ANY CORPORATE COMPANY IN TERMS OF INVESTMENT, WILL BE CRUSHED OWING TO COMPLIANCE BURDEN. ARUN JAITLEY USED TO HEAR THE CRIES OF SMALL AND MICRO ENTERPRISES BYPASSING THE ADVICES OFFICIALS AND OTHERS.

    It is every citizen’s duty to obey the law and pay taxes. Present GST law is friendly and easy to comply with. Quarterly filing is causing confusion. Govt should do away with quarterly returns. Professionals are there to help small traders.
    We all expect the Govt will provide good roads, affordable healthcare, education, the food at the subsidized price, security , etc. What on earth is easy. Let the taxman do their job and let us comply with the law and pay taxes.
