PUBLIC NOTICE NO. 39 (RE-00)/1997-2002

NEW DELHI , the 1st November, 2000

In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II-Section 3 – Sub- section (ii) vide S.O.No.283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol.1). (RE-00), 1997-2002.

(1) Paragraph 4.37 shall be amended to read as under:-

“The applicant shall furnish a self addressed envelop of 40X15 cm with postal stamp affixed on the envelope as follows:-

(i) For all documents required to be sent by Speed Post.

(a) Within local area Rs. 15.00/-

(b) Up to 200 Kms. Rs. 20.00/-

(c) Between 200 to 500 Kms Rs. 30.00/-

(d) Beyond 500 Kms. Rs. 45.00/-

(ii) For all documents required to be sent by Registered post.

(a) For licence Rs. 25.00/-

(b) For other documents Rs. 20.00/-

2. The following shall be added after the 2nd sentence, at the 6th line, of paragraph 7.8:-

Import of fuel may also be allowed under SION by ALC subject to the following: –

(a) It may be allowed only when it constitutes not less than 15% of the total cost of manufacture of the export product. The cost of manufacturing has to be determined taking into account the ex-factory value production of the resultant product as well as the international price of fuel used in the manufacture of such product.

(b) Fuel should be allowed only under SION and in no case should it be allowed either under paragraph 7.5 or under ad-hoc norms.

(c) Fuel should be allowed only against an actual user licence and therefore, fuel shall not be allowed for imports against DERC, which is transferable in nature.

(d) Even where fuel is included as an input under SION, it should not be taken into account while fixing the DEPB rate for the resultant product against which fuel has been allowed as an input.

(3) The following shall be added as paragraph 10.15(ii)(A):-

“ In case of supplies under paragraph 10.2(d),(e),(f) and (g), the indigenous supplier shall produce documentary evidence substantiating the realisation of proceeds from the recipient through the normal banking channel or should receive the payment through an account payee cheque”.

(4) The following amendments/corrections shall be made in the Appendix– 28A:-

(A)Product Group : Engineering (Product Code: 61)

(i) The following shall be added after S l. No: 599: –

(ii) The description of the export production at Sl. No: 581 shall amended to read as under:-

(i) The following shall be added after Sl. No: 987:-

(ii) The description of the Export product at Sl. No: 58 shall be amended to read as “ Paracetamon / Paracetamol Granules DC Grade 77%”.

(iii) The description of the export product at Sl. No: 65 shall be amended to read as “ S-Methoxy Morphinane HCL/(+)-3-Methoxy Morphinane HCL”.

(C) Product Group: Electronics (Product Code: 83).

(i) The entry at Sl. No: 66 of, shall be corrected to read as under:-

(D) Product Group: Miscellaneous Items(Product Code:90)

(i) The following shall be added after Sl. No: 23:-

(6) The following amendments shall be made in the Appendix– 48:-

(i) The Section 3(2)(i) of the Foreign Trade (Exemption from application of Rules in certain cases) order, 1993, as appearing at page “App,355” shall be amended to read as under:-

“Products approved for manufacture in and export or trading from the respective free Trade Zones/Export Processing Zones/Special Economic Zones and Export Oriented Units, except textile item covered by bilateral agreements, exports to Rupee Payment countries under the Annual Trade Protocol and Exports against payment in Indian Rupees to former Rupee payment countries.

Provided that conditions imposed in the letter of approval/letter of indent on an Export Oriented Unit or Export Processing Zone/Special Economic Zone unit will be binding on such a Unit”.

(ii) The entry at Sl. No: 7 of the Notification No: S.O.24(E) dated the 20th Jan., 1999, as inserted vide Notification No: S.O.194(E) dated the 6th March, 2000 shall be amended to read as under:-

“7 Development Commissioner, Export Processing Zone/Special Economic Zone Without limit in respect of Export Oriented Units and units in Export Processing Zone/Special Economic Zone under their jurisdiction.

(iii) The entry at Sl. No: 6 of the Notification No: S.O.1059(E) dated the 31st Dec., 1993 as inserted vide Notification No: S.O.193(E) dated the 6th March, 2000 shall be amended to read as under:-

“6 Development Commissioner, Export Processing Zone/Special Economic Zone Additional Secretary in the Ministry of Commerce aided by two Joint Secretaries and a Director of that Ministry”

(iv) The entry at Sl. No: 7 of the Order No: S.O.1060E) dated the 31st Dec., 1993 shall be amended to read as under:-

“7 The Development Commissioner/Joint Development Commissioner/Deputy Development Commissioner/Assistant Development Commissioner of a Free Trade Zone of Export Processing Zone or Special Economic Zone. Respective territorial jurisdiction of such authority”

(v) The entry at Sl. No: 7 of the Order No: S.O.1061E) dated the 31st Dec., 1993 shall be amended to read as under:-

“7 The Development Commissioner/Joint Development Commissioner/Deputy Development Commissioner/Assistant Development Commissioner of a Free Trade Zone or Export Processing Zone or Special Economic Zone. Respective territorial jurisdiction of such authority”.

7. The following shall be added after serial no. 4 under the head “ Rajsthan” in the Appendix– 51B:
