The Government of India, through the Ministry of Commerce, issued Public Notice No. 13 (RE-99)/1997-2002 on June 18, 1999, amending the Handbook of Procedures (Vol.1) under the Export and Import Policy, 1997-2002. The amendment, enacted under paragraph 4.11 of the Exim Policy, adds provisions to paragraph 10.11, extending deemed export benefits to supplies for setting up specified mega power projects. These include inter-state thermal power plants with a capacity of 1500 MW or more and inter-state hydel power plants with a capacity of 500 MW or more. Eligibility requires certification from a Government of India officer not below the rank of Joint Secretary in the Ministry of Power. The deemed export benefits, as specified under paragraph 10.3(a) to (d) of the policy, apply to goods listed in List 33 of the Department of Revenue Notification No. 63/99 dated May 13, 1999. This amendment aims to support the development of large-scale power infrastructure. The notification is issued in public interest by N.L. Lakhanpal, Director General of Foreign Trade, with communication facilitated by Ajay Sahai, Joint Director General of Foreign Trade.

NEW DELHI: the 18th June, 1999
In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II- Section 3 – Sub- section (ii) vide S.O No. 283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in the Handbook of Procedures (Vol.1) (RE-99), 1997-2002.
The following shall be added at the end of paragraph 10.11:
“However, supply of goods required for setting up of any mega power projects specified in list 33 of Department of Revenue notification No.63/99 dated 13.5.99, shall be eligible for deemed exports benefits as mentioned in paragraph 10.3(a)(b)(c) & (d) of the Exim Policy, if such mega power project is – (a) an inter state thermal power plant of a capacity of 1500 MW or more; or (b) an inter-state hydel power plant of a capacity of 500 MW or more,-as certified by an officer not below the rank of a Joint Secretary, Government of India in the Ministry of Power”.
