PUBLIC NOTICE NO. 11 (RE-00)/1997-2002

In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II-Section 3 – Sub- section (ii) vide S.O.No.283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol.1). (RE-00), 1997-2002.

1. The following shall be added at the end of the Paragraph 5.24

“However, transferability of such licences granted to Hotels/Restaurants/Travel agents/Tour operators may be allowed within their respective groups.”

2. Following amendments shall be made in paragraph –9.44

The word and expression “Development Commissioner/Customs” as appearing in second and third sentences of the above paragraph shall be amended to read as “Development Commissioner”.

3. Following amendments shall be made in Chapter 10:

The word and expression “paragraph 10.3(a) or (b) of the Policy” wherever appearing in paragraphs 10.3, 10.10(b), 10.11 and 10.11A , shall be substituted by the word and expression “paragraph 10.3(a) and (b) of the Policy “. However, in such cases where the firm is claiming the benefit under 10.3 (a), the benefit under 10.3(b) shall be confined to the items reflected in column 20 of Appendix– 11B.

4. Paragraph 12.15 shall be amended to be read as under :

“The exporter eligible for Golden status certificate, in terms of paragraph 12.14 of the Policy, shall submit their application in Appendix.1A and shall also enclose self attested photocopies of previous three status certificates alongwith a CA certificate indicating the FOB value of exports in the preceding year. They will be required to surrender current and valid recognition certificate, if any, held by them on date. Such applications shall be filed with the Directorate General of Foreign Trade ”

5. The second sentence of heading A(iii) of Appendix– 17 ,viz “Documents to be enclosed with application form”, shall be amended to read as under:

“However, in respect of supplies under paragraph 10.2 (d),(e),(f) and (g), wherever eligible for refund of TED, if the applicant is not able to furnish payment certificate, , he may alternatively furnish the copies of the excise invoices showing the receipt of the material by the Project Authority duly countersigned by the authorised person for this purpose as given in note (3)of Appendix– 14A, in lieu of payment certificate.”

6. In Appendix – 11I, the following shall be added at S.No.4 under the heading “List of documents to be attached”

1. Brand registration certificate issued under Trade and Merchandise Marks Act, 1958.

Or

Acknowledgment of application filed for the registration of brand under Trade and Merchandise Marks Act, 1958.

Or

A certificate of registration for foreign brands in their respective country provided the exports are made under the legend “Made in India”.

7. The following amendments shall be made in Appendix– 28A:

a. Product Group: Engineering (Product Code: 61)

i. The description of the Export product at S.No.53 shall be amended to read as under :

” Outdoor weather proof light fitting with Glass shell/Acrylic cover.”

i. The value caps for DEPB entitlement as given in column (4) of the above Appendix, shall be imposed as indicated against the following entry numbers:
