On 8th February 2006, the Government of India issued Notification No. 43 (RE-2005)/2004-2009, amending the ITC (HS) Classification of Export and Import Items. The amendment prohibits the import of various livestock and livestock products into India from countries affected by Highly Pathogenic Avian Influenza (Fowl Plague). This includes domestic and wild birds (except poultry), unprocessed meat and meat products from avian species, and semen of domestic and wild birds. The restriction extends to live poultry, day-old chicks, hatching eggs, meat from avian species, eggs, feathers, live pigs, and pig meat products, as well as pathological material and products of animal origin from birds intended for animal feed or agricultural/industrial use. This prohibition remains in effect until further orders from the government, aiming to safeguard public and animal health amid the reported outbreaks.

NEW DELHI, Dated: 8th February, 2006
S.O. (E) – In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy – 2004-09, the Central Government hereby amends the ITC (HS) Classification of Export and Import Items 2004-09 as under:
1. Condition 16 of Chapter 1 A (General Notes to Import Policy) of the ITC (HS) Classifications of Export and Import items, 2004-09 shall be amended to read as under:
“16. Import into India of the following livestock and livestock products shall be prohibited from all countries in view of the reported outbreak of Highly Pathogenic Avian Influenza (Fowl Plague):
(i) domestic and wild birds including the captive birds (excluding poultry);
(ii) unprocessed meat and meat products from Avian species including wild birds (except poultry);
(iii) semen of domestic and wild birds.
Further, the Central Government hereby prohibits also the import into India from the countries reporting the outbreak of Highly Pathogenic Avian Influenza (Fowl Plague), the following livestock and livestock products, namely:
(i) Live poultry;
(ii) day old chicks, ducks, turkey and other newly hatched avian species;
(iii) meat and meat product from Avian species including wild birds;
(iv) hatching eggs;
(v) eggs and egg products;
(vi) feathers;
(vii) live pig and pig meat products;
(viii) pathological material and biological products from birds;
(ix) product of animal origin (from birds) intended for use in animal feeding or for agricultural or industrial use.”
2. The prohibition shall be in force till further orders.
