Notification No. 29 (RE-2004)/2002-2007, dated January 28, 2004, amends the ITC (HS) Classification of Export and Import Items 2002-07. Key changes include the requirement for manufacturers/exporters to register with the Bureau of Indian Standards (BIS) for products subject to Indian quality standards, with a certification alternative for items imported for captive consumption. The notification also updates the import regulations for textiles, ensuring that hazardous dyes are not used, and introduces conditions for testing and certification. Specific amendments are made to the import licensing notes for various goods, including the exemption of certain items like cylinders and valves from compliance with BIS requirements. Additionally, new provisions are introduced for the import of vehicles under the EPCG scheme, specifying conditions for clearance and Type Approval Certificates from accredited organizations. Several import licensing conditions are modified, including the deletion of reporting requirements for newsprint imports and vehicle import conditions, aiming to streamline procedures and facilitate trade. These amendments are in line with the objectives of the Foreign Trade (Development and Regulation) Act, 1992.

NOTIFICATION NO. 31 (RE-2003)/2002-2007

NEW DELHI, DATED 29th January, 2004

S.O. (E) – In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 (No.22 of 1992) read with Paragraph 2.1 of the Export and Import Policy – 2002-07, as amended from time to time, the Central Government hereby amends the ITC (HS) Classification of Export and Import Items 2002-07 as under:

1.The following shall be added at the end of Chapter 1A- General Notes Regarding Import Policy of Schedule 1 of Import Policy of ITC (HS) Classification of Export and Import Items, 2002-07 as amended from time to time-

“16. Import into India of the following livestock and livestock products, namely:

i. domestic and wild birds,

ii. day old birds,

iii. turkey poultry and other newly hatched avian species,

iv. hatching eggs,

v. semen of domestic and wild birds,

vi. fresh meat of domestic and wild birds,

vii products of animal origin (from birds) intended for use in animal feeding or

viii. for agricultural or industrial use,

viii pathological material and biological products from birds which have not been

processed to ensure the destruction of the Highly Pathogenic Avian Influenza virus (Fowl Plague) from Republic of Korea, Vietnam, Thailand, Cambodia, Pakistan and Japan and such other countries reporting the outbreak of Highly Pathogenic Avian Influenza virus (Fowl Plague) shall be prohibited for a period of six months from the date of this notification or till such time it is modified or withdrawn, whichever is earlier.”
