The Government of India, through Notification No. 10 (RE-2006)/2004-2009, dated 13th June 2006, amended the ITC (HS) Classification of Export and Import Items. The amendment specifically adds a condition to Chapter 1A, under the General Notes regarding Import Policy. It mandates that the import of generator sets will be subject to compliance with the air emission and noise standards as specified in the Environment Protection Rules, 1986. These include notifications GSR 448(E) dated 12th July 2004, GSR 628(E) dated 30th August 2001, and GSR 682(E) dated 5th October 1999. This regulation aims to align the import of generator sets with environmental protection standards. The notification was issued in the public interest by the Director General of Foreign Trade, K.T. Chacko.

S.O. (E) – In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 2.1 of the Foreign Trade Policy – 2004-09, the Central Government hereby amends Schedule-I of the ITC (HS) Classification of Export and Import Items, 2004-09 as under:
The following condition will be added to chapter 1A: General Notes regarding Import Policy:
“20. Import of generator sets will be subject to the air emission standards & noise standards of the Environment Protection Rules, 1986 notified vide the following Notifications:
GSR 448(E) dated 12.7.2004.
GSR 628(E) dated 30.8.2001.
GSR 682(E) dated 5.10.1999.”
This issues in public interest.
