SUBJECTT : Issue of free Sale and Commerce Certificate for Medical devices/Equipments etc.
The Indian Exporters of Surgical and Medical Instruments have been representing that the Importers of their items are insisting for a “Certificate of free Sale and Commerce” as issued by the Ministry of Health of the exporting country.
2. The matter has been examined and it has been decided that the following procedure shall be followed for processing and issue of free sale/Commerce Certificate:-
i) The applicant will apply in a prescribed form (copy enclosed) giving the
prescribed Documents to the designated officers of the DGFT.
The request of the firm will be examined and necessary certificate Will be issued in respect of items not covered under Drugs and Cosmetics Act provided the items are not prohibited for export.
iii ) For Certificate involving the export of Medical devices covered under the Drugs and Cosmetics Act, the application will be transmitted to Ministry of Health for endorsement. Ministry of Health may require the documents such as GMP licence etc. to be annexed to the application by the applicant.
