Directorate General of Foreign Trade (DGFT) issued Trade Notice No. 05/2024-25-DGFT regarding the issuance of Registration-Cum-Membership Certificates (RCMC) for medical devices. The notice references an earlier public notice that designated the Export Promotion Council (EPC) for Medical Devices to issue RCMCs. However, since the EPC for Medical Devices has not yet started regular operations or integrated into DGFT’s digital platform, the industry faces difficulties obtaining RCMCs, which are required for RoDTEP benefits and customs clearance.

To address this, DGFT has decided that until the EPC for Medical Devices is fully operational, RCMCs can be issued by EEPC INDIA and other relevant EPCs. Customs authorities are requested to accept these RCMCs until further notice.

Subject: Issuance of RCMC for Medical Devices — regarding.

Reference is invited to DGFT Public Notice No. 18/2023 dated 23.06.2023 whereby Export Promotion Council (EPC) for Medical Devices was included in the Appendix 2T of FTP 2023 for issuing RCMC for specific items. Through the said Public Notice, it was inter alia notified that RCMC issued by EEPC INDIA till the date of issue of that Public Notice shall remain valid till their expiry.

2. Now it has been noted that the EPC for Medical Devices is yet to start regular functioning and could not onboard on the Common Digital platform of DGFT for issuance of RCMC. As one of the conditions for availing benefits under RoDTEP for medical devices is mandatory RCMC from the concerned EPC, the industry is facing difficulty in getting RCMC and clearance of their goods at Customs point.

3. Accordingly, the matter has been reviewed in DGFT and it has been decided that till such time the EPC for Medical Devices starts proper functioning, the RCMC may be issued by the EEPC INDIA and any other concerned EPC for Medical Devices.

4. Further, the Customs Authorities are requested to accept the RCMC for medical devices issued by EEPC INDIA and any other concerned EPC till further orders.
