The Ministry of Finance, Department of Revenue, issued Notification No. 42/2024-Customs on 6th September 2024, rescinding a previous notification dated 1st March 2011 (No. 26/2011-Customs). This decision was made under the powers conferred by Section 25(1) of the Customs Act, 1962, and Section 3 of the Customs Tariff Act, 1975, with the Central Government determining that this action is in the public interest. The rescinded notification originally pertained to customs regulations introduced in 2011. The new notification clarifies that the rescission will not affect any actions or omissions prior to its enforcement. The changes outlined in the notification will take effect from 7th September 2024. This update follows the most recent amendment to the 2011 customs notification made in July 2024 (Notification No. 38/2024-Customs). The rescission marks a significant regulatory shift in customs policies under the Customs Act and aligns with the government’s current customs management framework.

Notification No. 42/2024-Customs | Dated : 6th September, 2024

G.S.R. 546(E).—In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), read with section 3 of the Customs Tariff Act, 1975 (51 of 1975) the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby rescinds the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 26/2011-Customs, dated the 1st March, 2011, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 152(E), dated the 1st March, 2011, except as respects things done or omitted to be done before such rescission.

2. This notification shall come into force on the 7th day of September, 2024.
