 Notification No. 11/2001-Customs (N.T)

In exercise of the powers conferred by section 157 of the Customs Act, 1962 (52 of 1962), the Central Board of Excise and Customs hereby makes the following regulations to further amend the Courier Imports and Exports (Clearance) Regulations, 1998, except as respects things done or omitted to be done before such amendment, namely :-

1. (i) These regulations may be called the Courier Imports and Exports (Clearance) Amendment Regulations, 2001.

(ii) They shall come into force on the date of their publication in the official gazette.

2. In the Courier Imports and Exports (Clearance) Regulations, 1998, (hereinafter referred to as the said regulations) in regulation 2,-

(i)  in sub-regulation (1), for the words “incoming or outgoing flights”, the words “incoming or outgoing flights or by any other mode of transport” shall be substituted;

(ii) in sub-regulation (2), –

(a) in clause (a), for the words and letters “Ahmedabad and Jaipur”, the words and letters “Ahmedabad, Jaipur and land custom stations other than at Gojadanga and Petrapole in West Bengal” shall be substituted;

(b)  in clause (e), in sub-clause (iv), for the words “shipping Bill” the words “shipping bill or bill of export” shall be substituted.

3. In regulation 5 of the said regulations,-

(i) in sub-regulation (1), –
(A). in clause (a), –
(a) for the words “person in charge of aircraft”, the words “person in charge of aircraft or the authorised agent of Courier Service carrying goods by any other mode of transport” shall be substituted;
(b) for the words “airport by such aircraft”, the words “airport by such aircraft or the land custom station by any other mode of transport, as the case may be,” shall be substituted;
(c) for the words, figures, brackets and letters “Courier Bill of Entry-1 (CBE-1)”, the words, figures, brackets and letters “Courier Bill of Entry-1 (CBE-1) or Form Courier Bill of Entry – VI (CBE-VI), as may be applicable,” shall be substituted;
(B) in clause (b), for the words, figures, brackets and letters “Courier Bill of Entry-II (CBE-II)”, the words, figures, brackets and letters ” Courier Bill of Entry-II (CBE-II) or Form Courier Bill of Entry-VII (CBE-VII), as may be applicable”, shall be substituted;
(ii) in sub-regulation (2), in clause (b), for the words “person incharge of aircraft” the words ” person incharge of aircraft or the authorised agent of courier service carrying goods by any other mode of transport ” shall be substituted;
(iii) in sub-regulation (3), for the words, figures, brackets and letters ” Courier Bill of Entry-III (CBE-III), Form Courier Bill of Entry-IV (CBE-IV) or as the case may be in Form Courier Bill of Entry-V (CBE-V)”, the words, figures, brackets and letters” Courier Bill of Entry-III (CBE-III), Form Courier Bill of Entry-IV (CBE-IV), Form Courier Bill of Entry-V (CBE-V), Form Courier Bill of Entry-VIII (CBE-VIII), Form Courier Bill of Entry-IX (CBE-IX) or as the case may be in Form Courier Bill of Entry-X (CBE-X)” shall be substituted.
(iv) in sub-regulation (4), for the words “person incharge of aircraft”, the words “person incharge of aircraft or the authorised agent of courier service carrying goods by any other mode of transport” shall be substituted;

4. In regulation 6 of the said regulations, –

(i) in sub-regulation (1), –
(a) for the word “airport”, the words “airport or before crossing the international border by any other mode of transport at the land customs station” shall be substituted;
(b) for the words, figures, brackets and letters “Courier Shipping Bill-I (CSB-I) or Form Courier Shipping Bill-II (CSB-II)”, the words, figures, brackets and letters “Courier Shipping Bill – I (CSB-I), Form Courier Shipping Bill – II (CSB – II), Form Courier bill of Export – I (CBEx-I) or as the case may be in Form Courier bill of Export-II (CBEx-II)” shall be substituted;
(ii) in sub-regulation (2), in clause (b), for the word “flight”, the words “flight or across the international border by any other mode of transport” shall be substituted;
(iii) in sub-regulation (3), –
(a) for the words, figures, brackets and letters “Courier Shipping Bill-I (CSB-I) or Form Courier Shipping Bill-II (CSB)-II)”, the words, figures, brackets and letters “Courier Shipping Bill-I (CSB-I), Form Courier Shipping Bill-II (CSB-II), Form Courier bill of export-I (CBEx-I) or as the case may be in Form Courier bill of export-II (CBEx-II)” shall be substituted;
(b) in proviso, in clause (e), for the words “Shipping Bill”, the words “shipping bill or bill of export” shall be substitued.

5. In regulation 7 of the said regulations, for the words “Jaipur”, the words “Jaipur or as the case may be the Commissioner of Customs, West Bengal at Calcutta in charge of the land customs stations at Gojadanga and Petrapole” shall be substituted.

6. In regulation 11 of the said regulations, for the words “one lakh rupees in case of other airports” the words ” one lakh rupees in case of other airports and land customs stations” shall be substituted.

7. In regulation 12 of the said regulations, for the word “airport” the words “airport or land customs station” shall be substituted.

8. In regulation 13 of the said regulations,-

(i) in clause (c), for the words “shipment of ” the word “of ” shall be substituted;

(ii) in clause (d), for the word “shipment ” the word “Clearance” shall be substituted;

(iii) in clause (e), for the words “shipments of ” the word “of ” shall be substituted.

9. After form Courier Shipping Bill-II (CSB-II) appended to the said regulations, the following shall be inserted, namely:-

“Form Courier Bill of Entry-VI (CBE-VI)

Form Courier Bill of Entry-VII (CBE-VII)

Form Courier Bill of Entry-VIII (CBE-VIII)

Form Courier Bill of Entry-IX (CBE-IX)

Form Courier Bill of Entry-X (CBE-X)

Form Courier Bill of Export-I (CBEx-I)

Form Courier Bill of Export-II (CBEx-II).”
