Mandatory needed for getting agent registration under RERA (Haryana)

Every agent who intends to apply for RERA Agent registration with Gurgaon RERA Authority is mandatory required to get registered as Property Dealer with Collector in terms of Haryana Regulation of Property Dealers and Consultants Rules, 2009.

To understand the detailed procedure for agent registration with HRERA, let’s first discuss the concept of Property Dealer Registration.

Meaning of Property Dealer-Section 2(h) of Haryana Regulation of Property Dealers and Consultants Act, 2008-

Property Dealer means a person who has been granted a license under Sections 4 and 4 of this act to negotiates/facilitates in a sale-purchase transaction, lease and rent of plot, apartment, or any immovable property on a fees basis for his services whether as a commission or otherwise and includes property dealers, brokers, middlemen, etc.

Applicability- Haryana Regulation of Property Dealers and Consultants Act, 2008

This Act applies to the whole state of Haryana. It means every agent, broker, dealer, and mediator or whatsoever name called is required to get registered themselves as Property Dealer with Collector under Section 4 of the above said Act.

In the present scenario, No agent provide facilitate services in the sale-purchase transaction, lease, or rent of the plot, flat, apartment, immovable property, and building without having a valid registration number issued by Collector and agent registration with HRERA.

Statutory fees for Property Dealer Registration

(a) Fresh Property Dealer Registration

  • In case of Individual: Rs. 25,000/- (Rupees Twenty Five Thousand Only)
  • In case of other than individual: Rupees 50,000/- (Fifty Thousand Only)

(b) Renewal of Property Dealer Registration

  • In case of Individual: Rs. 5,000/- (Rupees Five Thousand Only)
  • In case of other than individual: Rupees 10,000/- (Ten Thousand Only)

Validity of Property Dealer Registration

This Property Dealer registration is valid for 05 (Five) years.

Procedure for Property Dealer Registration

Step-1 Submission of Application in Form-A

  • Four Passport Size Color Photograph of each Applicant
  • Address Proof of the Business premise of the Applicant
  • Self-attested copy of PAN and Aadhar of the applicant
  • The latest copy of acknowledgment of Income Tax Return (ITR) of the Applicant
  • Character Certificate of Applicant from any Gaz. Officer
  • Two Guarantors of Firm address with Photo & ID.
  • Undertaking of Solvency
  • Affidavit in terms of compliances the provisions of the Act and Rules made thereof
  • Attested copy of the PAN card;
  • Email id and Mobile No
  • Bank Details-Like canceled cheque\

Step-2 Scrutiny of the Application

On receipt of the application, the officer scrutinizes the application for acceptance.

Step-3 Police Verification

Once the application is accepted, it will be sent for police verification Department

Step-4 Approval of Application

After the police verification, if the licensing authority finds the application proper, It will issue the Certificate of registration in form B for five years.

Duties of Property Dealer

  • Property Dealer shall charge collectively upto 1% as the commission of the total cost of the immovable property in case of sale and one month rent in case of lease/rent of immovable property
  • Property Dealer shall display at all times the signage board bearing registered license number in the office.
  • Property Dealer shall arrange all the documents in relation to the immovable property for the purpose of deal and verify the genuineness of the same.
  • Property Dealer shall assist, corporate, arrange and support to any official/officer duly authorized in that behalf by the District Collector at any time to inspection
  • Property Dealer shall not involve in insider trading as well as not facilitated in dealing of unauthorized property
  • Property Dealer shall provide complete information about property/properties under transaction to the registering authority concerned.
  • Property Dealer shall maintain record of the transactions as provided in clause (x).
  • Property Dealer will maintain a register in Form D.
