Q. 1 I have Enroled for Aadhaar number but I am yet to receive the Aadhaar number, Can I still file my Income tax return?

Ans. Yes, you can quote the EID number mentioned on Acknowledgement/ EID slip provided by the enrolment centre at the time of enrolment while filing the Income Tax return.

Q.2 Is it mandatory to enrol for Aadhaar to apply for PAN in India? If yes, then what is the process for NRIs?

Ans. Section 139AA of the Income-tax Act, 1961 as introduced by the Finance Act, 2017 provides for mandatory quoting of Aadhaar /Enrolment ID of Aadhaar application form, for filing of return of income and for making an application for allotment of Permanent Account Number with effect from July 1’ 2017.

Mandatory quoting of Aadhaar or Enrolment ID will apply only to a person who is eligible to obtain Aadhaar number.

As per the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, only a resident individual is entitled to obtain Aadhaar. Resident as per the said Act means an individual who has resided in India for a period or periods amounting in all to 182 days or more in the 12 months immediately preceding the date of application for enrolment.

Q.3 Will my PAN become non-functional if I do not link it to Aadhaar?

Ans. UIDAI only issues Aadhaar and provides means to authenticate the same. For any product or scheme related queries, we request you to please get in touch with respective product/scheme owner. For PAN related queries, you are requested to please contact with Income Tax department.

Q.4 I do not have any Date of Birth proof. How do I update the DoB in Aadhaar or PAN to complete the linking?

Ans. In Aadhaar, if the resident provides documentary evidence of Date of Birth, then the Date of Birth is considered as “Verified”. When resident declares the DoB without any documentary evidence, then date of birth is considered as “Declared”.

Q.5 My date of birth in PAN and Aadhaar do not match. Not able to link them. Pls help?

Ans. You will have to correct your date of birth, either with Aadhaar or with PAN to link both. In-case linking problem still persists, we request you to please get in touch with Income Tax department.

Q.6 My name is different in PAN and Aadhaar. It is not allowing me to link both. What to do?

Ans. In order to Link Aadhaar with PAN, ideally your demographic details (i.e. Name, Gender and Date of Birth) should match in both the documents.

In case of any minor mismatch in Aadhaar Name provided by taxpayer when compared to the actual data in Aadhaar, One Time Password (Aadhaar OTP) will be sent to the mobile registered with Aadhaar. Taxpayers should ensure that the date of birth and gender in PAN and Aadhaar are exactly same.

In a rare case where Aadhaar name is completely different from name in PAN, then the linking will fail and taxpayer will be prompted to change the name in either Aadhaar or in PAN database.

Ans. Yes, Permanent account numbers (PAN) not linked to Aadhaar number will likely become invalid after 30th June 2018
