Drive India Enterprise Solutions Ltd Vs BGM Telecommunications Pvt (NCLAT Delhi)
National Company Law Appellate Tribunal (NCLAT), Delhi Bench, has set aside an order by the National Company Law Tribunal (NCLT) that summarily dismissed a Section 9 insolvency application filed by Drive India Enterprise Solutions Ltd. against BGM Telecommunications Pvt. The NCLAT, in a recent judgment, remanded the matter back to the NCLT for a fresh hearing, emphasizing the necessity of deciding each case on its individual facts and merits.
The core of the dispute revolved around the NCLT’s decision to dismiss Drive India Enterprise Solutions Ltd.’s application, seeking to initiate insolvency proceedings for an alleged unpaid operational debt of over ₹35.5 crore, primarily because the same operational creditor had previously filed two other Section 9 applications against different corporate debtors, which had been dismissed by other NCLT benches. The NCLT’s order stated, “the present application filed under Section 9 is covered by the said orders passed by Bench-II and Bench-VI and therefore dismissed.”
Simultaneously, an application by BGM Telecommunications Pvt. for punitive action against Drive India Enterprise Solutions Ltd., alleging fraudulent initiation of proceedings and non-disclosure of pre-existing disputes, was also dismissed by the NCLT, citing only the dismissal of the main Section 9 petition.
