NOTIFICATION
New Delhi, the 16th September, 2020

F. No. Stds/Additives-1/Notification/FSSAI/2018.—Whereas the draft of the Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2019, were published as required by the subsection (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Government of India, in the Ministry of Health and Family Welfare, Food Safety and Standards Authority of India F. No. F.No. Stds/Additives-1/Notification/FSSAI/2018, dated the 15th April, 2019, in the Gazette of India, Extraordinary, Part III, Section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas copies of the said Gazette were made available to the public on the 18th April, 2019;

And whereas objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by clause (e) of sub-section (2) of section 92 of the said Act, the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, namely:-

REGULATIONS

1. (1) These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives) Seventh Amendment Regulations, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette and Food Business Operator shall comply with all the provisions of these regulations by 1st July, 2021.

2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 (hereinafter referred to as said regulation),

(1) in clause 4 of sub-regulation 3.3.1 of regulation 3.3, after item (xi), the item”(xii) 4,5 epoxydec-2(trans)-enal” shall be inserted,

(2) in Appendix A, under the heading “IV. USE OF FOOD ADDITIVES IN FOOD PRODUCTS”,-

(a) In Table 1,relating to Dairy products and analogues, excluding products of category 2.0-

(i) under column (1) against the entries relating to the Food Category System 1.6.2, in column (3), after the food additive “Propionic acid, sodium propionate, calcium propionate”, the food additive “Pimaricin (Natamicin)” and the entries relating thereto in column (4), (5) and (6) shall be omitted;

(ii) under column (1) against the entries relating to Food Category System 1.6.4.1, in column (6), for the entry “Total salt content should not exceed 9,000 mg/kg calculated as phosphorous/ carbonates/citrate/ chloride”, the entry “33” shall be substituted;

(b) In Table 2 relating to Fats and oils and fat emulsions;

(i) under column (1) against the entries relating to in Food Category System 2.1.2,-

(A) in column (2), for the Food Category Name “Vegetable oils and fats”, “Vegetable oils, fats and bakery shortenings” shall be substituted;

(B) in column (3),against the entry relating to Food Additive “Lecithin” in column (4), for the entry “322 (i)”, the entries “322 (i), 322 (ii)”shall be substituted;

(C) in the column (3), for the entry relating to Food Additive “Monoglyceride citrate”, the entry “Citric and fatty acid esters of glycerol” shall be substituted;

(D) in column (3), against the entry relating to Food Additive “Sodium Citrate” in column (4) for the entry “331(iii)”, the entries “331(i)” shall be substituted;

(E) in column(3)after the food additive “THIODIPROPIONATES” and the entries relating thereto, the following shall be inserted, namely:-

“Lactic and fatty acid esters of glycerol 472b 10,000 mg/kg 408
Mono and diglycerides of fatty acids 471 GMP 408
Polyglycerol esters of fatty acid 475 5,000 mg/kg 408;”

(ii) under column (1) against the entries relating to food category system 2.2.2,-

(A) in column (2), for entry relating to Food Category Name “Fat spreads, dairy fat spreads and blended spreads (margarine, bakery shortenings and fat spreads)”, the entry “Fat spreads, dairy fat spreads and blended spreads (margarine and fat spreads)” shall be substituted;

(B) in column (3), against the food additive “SORBATES”, in column (5) for the entry “2,000 mg/kg”, the entry “1,000 mg/kg” shall be substituted;

(C) in column (3), against the food additive “ETHYLENE DIAMINE TETRA ACETATES (EDTA)”, in column (5) for the entry “100 mg/kg”, the entry “50 mg/kg” shall be substituted;

(c) In Table 5 relating to Confectionary, under column (1) against the entries relating to Food Category System 5.3, in column (3) against the Food Additive “Microcrystalline wax”, for the entries in columns (5) to (6), the following entries shall be substituted respectively, namely:-

(d) in Table 6 relating to Cereals and cereal products, under column (1) against the entries relating to Food Category System 6.2.1 and 6.2.2, in column (3), the Food Additive “Potassium iodate” and the entries relating thereto, shall be omitted;

(e) in Table 7 relating to Bakery Products, under column (1) against the entries relating to Food Category System 7.2.1, in column (3), the Food Additive “Potassium iodate” and the entries relating thereto, shall be omitted;

(f) in Table 12 relating to Salts, spices, soups, salads and protein products, under column (1) against the entries relating to Food Category System 12.2.2, in column (3) against the Food Additive “PHOSPHATES” in column (6), for the entry “26”, the entry “226” shall be substituted;

(3) In the said regulations, in the Notes to the Food Additives mentioned in the Table 1 to 15, after the Note No. 340 and the entries relating thereto, the following Note No. and entries shall be inserted, namely:-

“408 Only for bakery shortening”;.”
