Ministry of Corporate Affairs on 29th March, 2019 introduced the Companies (Incorporation) Third Amendment Rules, 2019 and amended Companies (Incorporation) Rules, 2014 had been amended.

New rule 38A has been inserted in the Companies (Incorporation) Rules, 2014. As per the newly inserted rule 38A, the application for incorporation of a company under rule 38 (SPICe) would now be accompanied by e-form AGILE (INC-35).

The name AGILE is a short form of ‘Application for Goods and service tax identification number, employees state Insurance corporation registration pLus Employees provident fund organization registration’.

E-FORM AGILE (INC-35) –

Through E-form AGILE (INC-35), the applicant can apply for registration of the following numbers –

1. Goods and Service Tax Identification Number (GSTIN) (with effect from 31st March, 2019; and

2. Employees’ Provident Fund Organisation (EPFO) (with effect from 8th April, 2019); and

3. Employees’ State Insurance Corporation (ESIC) (with effect from 15th April, 2019).

A company willing to be incorporated is required to obtain registration under various departments, separately. Introduction of new e-form AGILE would ease up the registration process. Rather than applying separately, now the company which are applying for incorporation through SPICe e-form can also apply for above listed registration through e-form AGILE which is being linked with SPICe e-form.
