The Institute of Chartered Accountants of India (ICAI) has announced a public comment period for proposed amendments to Regulation 204 of the Chartered Accountants Regulations, 1988. These amendments, which have received in-principle approval from the Ministry of Corporate Affairs, aim to formally introduce the term “Forensic Investigation” into the regulations.

As mandated by sub-section (3) of Section 30 of the Chartered Accountants Act, 1949, the draft notification was published in the Gazette of India, Extraordinary, on June 26, 2025. This publication initiates a formal process to gather feedback from individuals and entities potentially affected by the change. The ICAI has also made the notification accessible on its website for broader review. Stakeholders are invited to submit their comments on these draft amendments by July 31, 2025, through the provided online portal. This initiative by the Digital Accounting and Assurance Board seeks to refine the regulatory framework concerning accounting and assurance practices in India.

ANNOUNCEMENT

Sub: Inviting Public Comments on draft amendments in Regulation 204 of the Chartered Accountants Regulations, 1988

The Ministry of Corporate Affairs has accorded its in-principle approval on draft amendments in Regulation 204 of the Chartered Accountants Regulations, 1988. The proposed amendment introduces the term “Forensic Investigation” under Regulation 204 of the said Regulations.

In terms of the requirement of sub-section (3) of Section 30 of the Chartered Accountants Act, 1949, the notification containing draft amendments has been published in Part III Section 4 of the Gazette of India, Extraordinary, dated 26th June, 2025 seeking comments from the persons likely to be affected thereby. NOTIFICATION

New Delhi, the 26th June, 2025

No.1-CA(7)/227/2025.—The following draft of certain regulations further to amend the Chartered Accountants Regulations, 1988, which the Council of the Institute of Chartered Accountants of India proposes to make, is hereby published, as required by sub-section (3) of section 30 of the Chartered Accountants Act, 1949 (38 of 1949) for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulation shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of the Gazette of India, in which these draft regulations are published, are made available to the public;

Any person desiring to make any objection or suggestion in respect of the said draft regulations, may forward the same to the Council of the Institute of Chartered Accountants of India within the period so specified addressed to the Secretary, the Institute of Chartered Accountants of India, ICAI Bhawan, Indraprastha Marg, New Delhi – 110 002;

Any objection or suggestion which may be received from any person with respect to the said draft regulations before the expiry of the period so specified shall be taken into consideration by the Council.

Draft Regulations

I. (1) These regulations may be called the Chartered Accountants (First Amendment) Regulations, 2025.

(2) They shall come into force on the date of their final publication in the Official Gazette.

II. In the Chartered Accountants Regulations, 1988, –

In Regulation 204,

(i) After the words, “International Taxation”, the word “and” shall be omitted.

(ii) After the words, Management and Business Finance, the words, “and Forensic Investigation” shall be inserted.
