This Public Notice is issued for continuance of deemed export benefits for supplies made to Maharashtra State Electricity Board for early execution of the second Maharashtra Power Project in the wake of withdrawal of World Bank loan, subject to the terms and conditions mentioned in the foregoing paragraph and in Appendix – 14A of Handbook of Procedures (RE:99).
In the light of above stated two changes the issue was discussed with Deptt. of Economic Affairs and Deptt. of Revenue and it has been decided to withdraw Policy Circular No. 57 dated 10th December, 1998. Accordingly, Policy Circular No. 57 dated 10th December, 1998 is withdrawn and DGFT Circular No. M-3(2)/AM92/DBK Cell dated 18th March, 1994 stands. Even the supplies effected between 16th December, 1998 to 31st March, 1999, and thereafter, shall also be entitled for deemed export benefits as clarified by DGFT Circular No. M-3(2)/AM92/DBK Cell dated 18th March, 1994.
Notification 28(RE-99)/1997-2002 revises Niger Seeds export rules, introducing canalisation and agency-specific guidelines for exports to the USA.
Export of finished goods direct from the job worker’s premises may be permitted provided the job worker’s premises is registered with the Central Excise Department. However, export of such products from the job worker’s premises shall not be allowed through third parties as provided under paragraph 9.11 of the Policy.
In exercise of powers conferred under section 5 of the Foreign Trade (Development and Regulation) Act, 1992 read with paragraph 1.3 and 4.1 of the Export and Import Policy, 1997-2002, the Central Government hereby makes the following amendments in the ITC(HS) Classifications of Export and Import Items , 1997-2002 published on 31st March, 1997 (RE-98) as amended from time to time, namely/.
The deemed export benefits for these projects would be subject to the conditions that in case OECF assistance for the 2nd/subsequent tranche does not materialize, respective project authority would fully reimburse all the deemed export benefits to the Government of India.
Public Notice No. 29(RE-99)/1997-2002 updates Export and Import Policy, including changes to EPCG licence, export obligations, and product descriptions.
It is clarified that provision incorporated under Public Notice No. 53(RE-98)/97-2002 dated 6th Nov, 1998 relating to surrender of SIL for valuewise shortfall as stated above shall be applicable to the licences issued prior to 1.4.97 relating to any Policy period where cases are still pending for regularisation.
Kind attention is invited to Policy Circular No. 17/96-97 dated 1.10.1996. It has been clarified, therein, that for the purpose of fulfillment of export obligation, the EPCG licence holder should export cotton yarn of 41 counts and above and in case he intends to export cotton yarn of less than 41 counts , then, raw cotton shall be imported. The matter has been reviewed by the Empowered Committee under the chairmanship of Secretary.
The exporters who were holding recognition certificate for the period 1998-99, under Export Import Policy 1997-2002 or under Exim Policy 1992-97 and have also obtained recognition certificate under the current Policy have an option to claim SIL based on exports made during preceeding licensing year subject to following conditions.
