As the GST Council is being chaired by the Finance Minister, who has hundreds of other commitments, it is not possible for her to concentrate fully on GST related issues. Ahilya Chamber, therefore, requests that a independent dedicated ministry with Cabinet Rank, headed by an Taxation Expert, be created for GST.
Biggest reason for non-filing of GSTR 9, 9A and 9 C is the complexity of these forms and asking for data which was not captured during the concerned period. Our submission is that if the supplier has not reduced its GST liability to the extent of the relevant amount, issuance of such commercial credit notes for price discounts do not result in any loss to the exchequer and a clearly worded notification saying that no tax liability will arise in such cases, either on the supplier or the recipient, needs to be issued in this regard to avoid double taxation.
The latest example is the enormously lengthy yearly return forms 9, 9A & 9C. While taxpayers are finding it difficult to provide the required information, Chartered Accountants are also at a loss – despite clarifications – as to which data is to be filled where in so many fields. Local GST authorities are also not in a position to help.
GST Council Chairman requested to take up the issues on GST Website strongly with his IT team to understand all problems in details; take a SHUTDOWN of portal for 48 to 96 hours if necessary, fix all bugs, conduct exhaustive and vigorous testing of portal, resolve all tickets logged till date and make the system stake holder friendly.
