Public Notice No. 50/2023-DGFT, dated March 11, 2024, issued by the Directorate General of Foreign Trade (DGFT), introduces amendments to the import provisions concerning inputs subjected to mandatory Quality Control Orders (QCOs) by Advance Authorisation holders, EOU, and SEZ.

Analysis: In accordance with the Foreign Trade Policy (FTP), 2023, the DGFT exercises its powers to update the list of Ministries/Departments exempted from mandatory QCO notifications. The amended Appendix 2Y, replacing Public Notice No. 47/2023, now includes the following Ministries/Departments:

  1. Ministry of Steel
  2. Department for Promotion of Industry and Internal Trade (DPIIT)
  3. Ministry of Textiles

This update streamlines the process for Advance Authorisation holders, EOU, and SEZ, enabling them to import inputs without being subjected to mandatory QCOs as per the notifications of the listed Ministries/Departments.

Conclusion: With the issuance of Public Notice No. 50/2023-DGFT, the import provisions for Advance Authorisation holders, EOU, and SEZ are enhanced, providing clarity and convenience in importing inputs subjected to mandatory QCOs. Stakeholders can benefit from this amendment by referring to the updated list of Ministries/Departments under Appendix 2Y of the FTP, 2023, ensuring smoother import procedures for manufacturing export products.

Public Notice No. 50/2023-DGFT | Dated the 11 March 2024

Subject: Enabling provisions for import of inputs that are subjected to mandatory Quality Control Orders (QCOs) by Advance Authorisation holders, EOU and SEZ – regarding.

F. No.01/89/180/13/AM-15/PC-2[A]/E-5910.: In exercise of powers conferred under paragraph 1.03 and 2.04 of the Foreign Trade Policy (FTP), 2023, the Director General of Foreign Trade hereby makes amendment in the list of Ministries/Departments whose notifications on mandatory QCOs, that are exempted by the DGFT for goods to be utilised/consumed in manufacture of export products. Accordingly, list of Ministries/Departments is updated in supersession of Public Notice No. 47/2023 dated 07.03.2024. The updated Appendix 2Y is reproduced herewith :

Effect of this Public Notice:

In pursuance of Notification No. 71/2023 dated 11.03.2023, a new Appendix 2Y under FTP, 2023 has been created with immediate effect and list of Ministries/Departments whose notifications on mandatory QCOs, that are exempted by the DGFT for goods to be utilised/consumed in manufacture of export products, have been updated.
