Ramesh Jethi Vs Directorate General of GST Intelligence (Delhi High Court)
1. This petition is filed with the following prayers:-
(a) Issue a Writ of Mandamus directing the officers working under the charge and subordinate to learned Respondent to permit presence of Petitioner’s counsel while interrogating in conformity with the law propounded by the Hon’ble Supreme Court and this Hon’ble Court cited supra; and/
(b) Direct learned Respondent to conduct interrogation without harassing following the guidelines laid down by the Hon’ble Supreme Court in judgments cited supra, promptly without undue delay and during the office hours i.e. from 10:00 A.M.to 5:00 P.M with usual breaks; and/or
2. I have gone through the complaint made to the police annexed as annexure P3. The police complaint does not indicate any real and live possible threat which per se is required for seeking relief as sought in the petition.
3. In view of above, no ground is made out for interference at this stage. Petition stands dismissed. Pending application, if any, also stands disposed of.
