In re E-Square Leisure Pvt Ltd (GST AAR Maharashtra)

Question :- Whether GST is levied on the reimbursement of expenses from the lessee by the lessor at actuals?

Answer :- Answered is in affirmative.

Question :- In case GST is levied, what is the rate of GST applicable to said reimbursement of expenses ?

Answer : As the reimbursement of the expenses constitute composite supply GST would be payable at a rate as applicable to the principal supply.

    Banks are collecting the GST Charges from the Borrowers and any type of account holder with the bank but not showing the GST charges thus included with the other charges. Whether a Bank or the Bank can do like this. If yes, what Rule says for the same and if not, what action can be taken against the Bank for doing such mischief fraud into the accounts. A details comments required with authentic Document of Circulars required and rule of Penalty need to be informed.

    Whether any Bank collect or impose 18% GST charges on Processing Fees without showing the bifurcation showing about GST amounts by including with whole sum amount as Processing charges.
    For any other charges debited also add up the GST charges but not showing the quantum of GST charges being included in it. Whether the Banks can do like this without mentioning the amount how much is imposed.

    A Nationalized Bank is Paying Rent of Rs.50,000/- and also paying the 18% GST Charges on Rent Amount. But again deducting from the Rent amount further GST TAX 2% on GST Amounts. Whether the Bank can deduct this 2 % as TAX amount on GST Tax amount from the Rent Amounts.
