Subject: – Current status of filing of withdrawal applications before various Appellate FORA as required vide Member (CX,ST & L)s DO letter dt 11.07.2018 and 06.09.19 and subsequent letters dt 04.09.2018 : Regarding

Reference : Instruction dt 11.07.2018 from F. No. 390/Misc/116/2017-JC Member’s DO Letter DOF 390/Misc/116/2017-JC dt 06.09.2018

Pl refer to the above mentioned subject. With regard to the position of filing and withdrawal of cases falling below monetary limits, Chairman (CBIC) has directed that the entire exercise should be positively completed by 30.09.2018

2. As you are already aware a consolidated list of cases ripe for withdrawal from the Supreme Court has already been compiled. This has been sent to the CAS for requisite drafting of interlocutory application/filing of single application on the advice of the Ld AG. The idea behind this, is to ensure that the withdrawal takes place in a single move. It is evident that valuable time would be saved ,as filing of many separate applications would not be required.

3. Since there is a deadline for completion of the entire exercise, the Zones may adopt a similar action for filing single consolidated withdrawal application, in respect of all identified cases, pending in the High Courts and Cestat under your charge.

4. After completion of the withdrawals a consolidated report may please be sent to this office by 01.10.18 so that the position could be put up further for perusal
