Public Notice No. 17 (RE-05)/2004-2009, dated 7th June 2005, issued by the Directorate General of Foreign Trade (DGFT), amends Para 4.7 of the Handbook of Procedures (Vol. I) under the Foreign Trade Policy, 2004-09. The amendment allows the issuance of Advance Licences based on self-declaration and an undertaking for final adjustments according to the Adhoc/SION fixed by ALC. However, the notice prohibits the issuance of Advance Licences for imports of specific products, including vegetable/edible oils, oilseeds, cereals, certain spices, fruits/vegetables, pepper, and animal products under specified chapters of the ITC (HS) book. Additionally, exporters of perfumes, perfumery compounds, and feed ingredients must apply under a different procedure, Para 4.4.2. For biotechnology items, licenses can only be issued upon submission of a ‘No Objection Certificate’ from the Department of Biotechnology. This amendment aims to regulate the issuance of Advance Licences and ensure compliance with specific restrictions on import and export items.

PUBLIC NOTICE NO-17 (RE-05) /2004-2009

NEW DELHI, DATED 7th June, 2005

In exercise of powers conferred under paragraph 2.4 and paragraph 4.1.3 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures (Vol. I):

Para 4.7 is amended to read as under:
“ 4.7 The licensing authority may also issue Advance licences, where SION are not fixed, based on self declaration and an undertaking by the applicant for a final adjustment as per Adhoc/SION fixed by ALC.

However, no Advance Licence shall be issued under this para by the licensing authority for import of the following products.

All vegetable/edible oils classified under Chapter – 15 and all types of oilseeds classified under Chapter – 12 of ITC (HS) book;
All types of cereals classified under Chapter – 10 of ITC (HS) book;
All spices, other than Light Black Pepper (light berries), having a duty of more than 30%, classified under Chapter-9 and 12 of ITC (HS) book; and
All types of fruits/vegetables having a duty of more than 30%, classified under Chapter 7 and 8 of ITC (HS) book.

For export of perfumes, perfumery compounds and various feed ingredients containing vitamins, no licence shall be issued under this para by the licensing authority and the applicants may apply under Para 4.4.2 of this Handbook.

Where export and/or import of biotechnology items are involved, licence under this para shall be issued by the licensing authority only on submission of a ‘No Objection Certificate’ from the Department of Biotechnology.”
