PUBLIC NOTICE NO. 14 (RE-2005) /2004-2009

NEW DELHI, DATED THE 30th MAY, 2005

In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures (Vol. I)2004-2009 updated as on 31st.March 2005.

1. Para 5.3.2 shall be amended to read as under:

“The licence holder shall produce to the concerned licensing authority a certificate from the jurisdictional Central Excise authority confirming installation of Capital goods at the factory/premises of the licence holder or his supporting manufacturer(s) vendor(s) within six months from the date of completion of imports.

However, licence holders who are not registered with Central Excise Authorities and service providers can give a certificate either from the jurisdictional excise authority or an independent Chartered Engineer confirming installation of movable and immovable capital goods at the premises of the licence holder/supporting manufacturer.”

2. The first sentence of Para 5.19 (c) shall be amended to read as under:

“For all the EPCG licences, the licence holder should have fulfilled the mandated (original or amended, as the case may be) block wise export obligation at the end of the previous block in which the application is made”.

3. Para 5.19(d) shall be amended to read as under:

“In cases where the remaining original export obligation period (and not the extended export obligation period) of the EPCG licence is less than two years on the date of application for refixation, and the mandated (original or amended, as the case may be) block-wise export obligation has been fulfilled, the export obligation would be refixed at two times the duty saved on the date of issuance of licence.

4. Para 6.21.1 (d) shall be amended to read as Under:

“EOUs shall be eligible for wastage as applicable as per para 4A.2 of Hand Book for sub-contracting and against exchange.”

5. The second sub Para of Para 6.27.2 beginning with words “In addition to this ——“ shall be re-numbered as para 6.27.3.

6. The following agency is added in Appendix 4 C pertaining to the “List of Agencies authorised to issue Certificate of Origin (Non Preferential)”:

7. Last sub para Para 4.16 shall be amended as under:

“In case Bank Guarantee/LUT has been redeemed, the licencee can get the duty free inputs processed from any manufacturer under actual user condition as per job work regulations prescribed under the Central Excise Rules”.
