Mumbai South CGST Commissionerate detected a fake ITC case of about Rs. 270 crores relating to diamonds, whether or not worked but not mounted or set. Mumbai GST zone has appreciably stepped up its all-round anti-evasion work.

i. Besides intimating to the Zonal Member concerned, arrest reports shall also be intimated to the Member (Investigation). Further, I am directed to reiterate that: ii. A monthly report of all persons arrested in the Zone shall be sent by the Chief Commissioner to the Principal Director General/ Director General of Revenue Intelligence in the format prescribed, by the 5th of the succeeding month.

CESTAT ask registry to adhere to SC direction on period of limitation

The Registry should not insist for a delay condonation application to be filed in appeals governed by the above said order of the Supreme Court. If an appellant, however, desires to take the benefit of the order dated 23.09.2021 passed by the Supreme Court, then such a statement should be made by the appellant in the verification column and in the respective column of the date of receipt of impugned order in EA-3/CA-3/ST-5 Form. All concerned are, therefore, required to adhere to the aforesaid directions.

The Government, on the recommendation of GST Council made during its 45th Meeting, notified certain amendments in CGST Rules, 2017 vide Notification No. 35/2021-Central Tax dated 24.09.2021. Besides, 4 circulars were also issued last week to clarify various issues pertaining to GST. These include clarification on the interpretation of scope of “intermediary services” and “establishment of distinct persons” for considering supply of a service as export of service.

A detailed analysis to pursue trends in cases of GST evasion & fraudulent ITC availment booked viz-a-viz number of SCNs issued against for the FY 2017-18 [w.e.f. July, 2017], 2018-19 & 2019-20, have been made and it is observed that in GST evasion cases booked and in the Fraudulent ITC cases booked, during the above mentioned period, SCNs have been issued only in few cases.
