In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Paragraph 1.1 and 2.4 of the Export and Import Policy, 2002-2007, the Central Government hereby makes the following amendment in the “ITC (HS) Classifications of Export and Import Items, 2002-2007” as amended from time to time.
Attention is invited to Policy Circular No.17(RE.2003)/2002-07 dated 10.10.2003 wherein all Licensing authorities were advised to follow the instructions contained therein on the admissibility of the import of Natural Rubber against Advance Licences/DFRC/Advance Licence for annual requirement, in respect of licences issued on or after 20.02.1999. It was stipulated that such licences would be revalidated upto 31.12.2003.
Representations have been received to allow inter unit transfer of the inputs imported/ procured against advance licence. The matter was deliberated upon in the Policy Interpretation Committee (PIC) and it was decided to allow transfer of raw material from one unit to another unit of the same company. Accordingly, a new Sub-paragraph may be incorporated as follows.

The revised DEPB rate (value cap) would be applicable on exports made from the date of its notification and also for the shipment passed by the Customs on or after 14.1.2003 on provisional basis pending fixation of revised DEPB rate for this item.
Representations have been received by this office that in case of export of pharmaceutical formulations under DEPB, sometimes rate is worked out in fractions when calculated as per the formula prescribed by the Policy Circular No.20 dated 31.7.2002. They have further stated that as per existing practice, the DEPB entitlement rate is rounded off to the nearest digit. However, while verifying the DEPB, some Customs authorities are reducing the DEPB amount in respect of cases where the rate has been rounded off to the higher side but where the rate has been rounded off on the lower side, there is no increase allowed in the DEPB amount.
Import of SKO shall be allowed through State Trading Enterprises (STEs) i.e. IOC, BPCL, HPCL and IBP for all purposes with STC being nominated as a State Trading Enterprise (STE) for supplies to Advance Licence holders. Advance Licence holders shall however, have the option to import SKO from the above mentioned STEs including STC.
Notification No. 23 (RE-2003)/2002-2007 adds Anthranilic Acid to ITC (HS) Classifications with export restrictions under the Narcotics Commissioner’s approval.
Attention is invited to Public Notice No. 14 dated 31.5.2002, read with the relevant portions of Public Notice No. 33 dated 26.8.2002 and Public Notice No.53 dated 31.12.2002, which introduced a special provision for exemption of special additional duty (SAD) on DEPBs issued under the Exim Policy 2002-07 where the order of “Let Export” was prior to 1.4.2002.
EPCG applications for issue of licenses where the Duty saved amount is upto Rs.50 crores, will continue to be submitted to the concerned Regional Licensing Authority, as per the jurisdiction indicated in Appendix 24 of the HB of Procedure Vol.I. In respect of the above cases, where the duty saved amount is upto Rs.50 crores and licenses have been issued on or after 1.10.2003, the RLA shall not forward such cases to DGFT(HQ) for nexus fixation. The process of nexus fixation in respect the above cases shall be done by the RLA themselves. Further, where the duty saved amount is more than Rs.50 crores, EPCG applications shall also be submitted to the concerned RLA with a copy to DGFT(HQ). In such cases, necessary instructions shall be issued by the DGFT(HQ) to the concerned RLA for issuance of licences after fixation of nexus within the prescribed time of two months.
