Advance Licences. In Civil Writ Petition No.808 of 2002 in the case of M/s. Narendra Udeshi V/s. Union of India, the Hon’ble High Court of Bombay vide its judgement dated 1st Oct., 2002 quashed and set-aside the ALC Circulars including Circular dated 3rd September, 2001 and Public Notice dated 20th May, 2002. The SLP filed before the Hon’ble Supreme Court against the judgement of the Bombay High Court has also been dismissed.

Attention is invited to ALC Circular Nos. 8/98-99 dated 20.2.99,1/2001-2002 dated 23.8.2001, 2/2001-02 dated 3.9.2001 and Public Notice No.13/2002-2007 dated 20.5.2002. Vide these Circulars and Public Notice, all Licensing Authorities were advised not to issue any duty free licence including DFRC, Advance Licence for deemed exports, Advance Intermediate Licence and Annual Advance Licence for import of natural rubber.

Imports of approved & unapproved drugs under the Advance Licensing Scheme–Exemption from Registration procedure

Subsequent to the above Notification, representations have been received from various Drug Manufacturers Associations requesting for exemption from registration requirements of the Drugs & Cosmetics Act for imports under the Advance Licensing Scheme. The requests have been considered and It has been decided that import of approved & unapproved drugs under the Advance Licensing Scheme will not be subjected to the Registration procedure and the imports will be permitted subject to the following conditions.

Each IEC holder (baring those who have obtained IEC in the preceding licensing years i.e 1.4.2002 to 31.3.2003) shall be required to furnish yearly details of imports/exports made by him in the preceding licensing year by 31st October. The information shall be furnished online by the IEC holder by accessing the website at www.nic.in/eximpol. Failure to submit the details by the stipulated period shall result in blocking of such IEC for import/export purposes from 1st November.

Whenever the SION of a product are on content basis (i.e., —kg/kg content in export product ) and/or the components are in numbers, the exporters are required to submit ‘Bill of Material’ indicating net weight of export product (as shown in the Shipping Bill) and net weight of each input, imported as well as indigenous, to verify their contents in the export product.

Export obligation fulfilment criteria in the case of bonding of an EPCG licence holder under the EOU scheme

The meeting of the Policy Review Committee on 18th August, 1999 had decided that in the case of a bonding of an EPCG licence holder under the Export Oriented Unit (EOU) scheme wherein the EPCG licence was issued on or after 5th June, 1995 , the Bank Guarantee ( BG) executed under the EPCG scheme would be redeemed only if the EPCG licence holder executed an Legal Undertaking (LUT) with the Development Commissioner of the EOU and there was no liability under the EPCG scheme under the blockwise period criteria of export obligation fulfilment.

Consequently the last sentence thereof, namely , “Therefore in all such cases where exports of “MS Galvanized Sheets/Strips” have been cleared for DEPB benefit under the entry at Sl.No. 91 or the DEPB benefit has been granted against the entry at Sl.No. 91 consequent remedial action should be initiated immediately, shall be deleted.
