In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 (Sl. No.66) read with Para 1.3, 2.1 & 2.29 of the Foreign Trade Policy, 2004-2009 (as amended from time to time), the Central Government hereby makes following amendments in the Schedule-2 of the ITC(HS) Classifications of Export and Import Items, 2004-2009.
In para 3.12 after the existing 2nd sub para which reads as “Notwithstanding anything stated above, exporters of Drugs & Pharmaceuticals shall obtain RCMC fromPharmexcil only”, the following shall be added.
In exercise of powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act, 1992 (No.22 of 1992) read with paragraph 1.3 of the Foreign Trade Policy, 2004-09 as amended from time to time, the Central Government hereby makes the following amendments.
Representations have been received in this office that some of the RLAs are allowing coal only with Actual User condition under DFRC scheme even if the same is available in SION, on the ground that coal is a fuel, which can be allowed with the condition as per paragraph 4.2.3. of the F.T.P.(2004-09), stated above. The mater was discussed in the ALC meeting in consultation with the Policy Division and it has been decided to clarify that wherever coal has been allowed as one of the inputs in SION i.e. when its consumption is directly related to the manufacturing of the export product and not for generation of power, it should be treated at par with other inputs which are transferable under DFRC.
In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2004-2009 and Paragraph 1.1 of the Handbook of Procedures (Vol.1), the Director General of Foreign Trade hereby makes the following amendments in the Book titled “Schedule of DEPB rates.

Every advance licence holder shall maintain a true and proper account of consumption and utilization of duty free imported / domestically procured goods against advance licence as per the format given in Appendix 23. These records are required to be sent to the relevant licensing authority(s) at the beginning of each licensing year for all those licences, which have been redeemed in the previous licensing year. However these records in the said format are required to be submitted for licences issued on or after 13.05.2005. Such records should be preserved for a period of at least three years from the date of redemption.

Representations have been received from the trade and industry that a doubt has arisen in the field formations of customs on the issue of allowing alternative inputs as per SION under DFRC scheme even if exactly the same input, in the product value added chain, has not been utilized in the manufacture of the exported product.
This Directorate has been receiving representations from various quarters seeking clarifications as regards the Classification of certain specific items under the ITC(HS) Classifications of Export and Import Items, 2004-09. Such requests for issue of appropriate clarifications etc. have been examined and based on the decision(s) arrived in consultation with the concerned Administrative Ministry/Departments.
