PUBLIC NOTICE NO. 60 (RE-2005) /2004-2009

NEW DELHI, DATED THE 10th OCTOBER, 2005

In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in the Handbook of Procedures (Vol. I):

Appendix 23 stands amended as per the Annexure attached to this Public Notice.
Paragraph 4.25(v) related to both physical exports and deemed exports and Paragraph 4.28(v) as incorporated vide PN 8 dated.13th May, 2005 stands deleted.
At the end of paragraph 4.26 related to “Redemption” of advance licence, a new sub-paragraph is added as follows:
Further the licensing authority shall also take action against the licensee in case of non submission of duly filled in Appendix –23, as stipulated in paragraph 4.30 of the Handbook, vol. 1 or for any mis- representation, mis-declaration and default detected subsequently in the details declared & furnished in Appendix –23. An endorsement to this effect should be made by the licensing authority in the redemption certificate.

Paragraph 4.30 should be amended to read as follows :
Every advance licence holder shall maintain a true and proper account of consumption and utilization of duty free imported / domestically procured goods against advance licence as per the format given in Appendix 23. These records are required to be sent to the relevant licensing authority(s) at the beginning of each licensing year for all those licences, which have been redeemed in the previous licensing year. However these records in the said format are required to be submitted for licences issued on or after 13.05.2005. Such records should be preserved for a period of at least three years from the date of redemption.

5. In the “Guidelines for applicants” of Aayaat-Niryaat Form, after Sl. No. 3.b.iii, a new provision is added as Sl. No. iv as follows:

iv. Invalidation letter(s) incase of supplies to an advance licence or DFRC holder.
