Sir / Madam

Sub: Request for Extension of Due date in filing the Returns of Income under Income tax act for the Asst year 2019-20 [Financial year ending 31st of March 2019] – reg.

 ****

The Due date for filing the Income tax returns was extended till 30th of June 2020 and later by one more month i.e. till 31st of July 2020 because of the prevailing Pandemic due to COVID-19.

However the Pandemic has not ended and the conditions have worsened since then. Many of the states have declared lockdown on own and the spread of the disease has multiplied because of Community spread.

States like West Bengal and Karnataka [partly] are under lockdown till the end of July. Many Districts and towns of Maharashtra are still under lockdown. Nagpur city of Maharashtra and other cities have extended their lockdown till 31st of July 2020. Buldana District in Maharashtra has already announced extension of Lockdown till 21st of August 2020.

Due Date

Various other cities and towns in various states are contemplating of imposing or extending lockdown until next month. Parts of Various cities and towns in the country are under self imposed lockdown because of the spread of the disease and the possible threat to the lives of people.

The Government itself has advised people not to move outside and in our places like Nizamabad, most of the trade associations, fearing the spread, are observing self proclaimed lockdowns and are strictly observing the lockdown rules. It is impossible to trace the victims and in some cases the Health workers [Medical Professionals] themselves are the victims of the Pandemic forcing them to shut down their Hospitals.

Many assesses who are themselves infected are either hospitalized or are under quarantine and are not in a position to discharge their statutory responsibility.

Many trade associations have imposed self lockdowns which in many cases are getting extended beyond 31st July and hence are handicapped from filing their returns.

In the States of Telangana and Andhra Pradesh too, the pandemic is not relenting and it has taken serious proportions now. The traders have been resorting to ‘self-lock down’ for preventing spread of the disease. People are living in constant fear. In view thereof, it is not possible for the traders and their tax representatives to focus on tax matters now.

In this context, we request you to take fair view of the matter and extend the due date of filing the returns as given hereunder.

The due date of filing the Returns of income may please be extended as under: –

Assessment Year Financial Year Due date to be extended to
2019-20 01-04-2018 to 31-03-2019 30th September 2020
2020-21 01-04-2019 to 31-03-2020 31st December 2020

We look forward for a fair consideration on the above stated issue.

Thank you

For Tax Bar Association, Nizamabad

Hi all, Frankly speaking this year the filings should be allowed up to March 31, 2021 .The Govts have now started sealing the houses/ offices/shops of those infected. That being the case , there is no guarantee that one can work all the time

  21. sargam says:

    Sir,
In this Pandemic, there is no guarantee that C.A. or Company Secretary etc will live or the staff working with C.A. and comapny secretary or assessee offices will remain live or no one can state who when will get infected of Corona so it will be better this year ie for completing the Income Tax, GST or corporate affairs compliances you keep any fix due date

  22. CA Lakshminarasimhan says:

It is a perfectly valid request for extension. For eg. I myself affected by corona in Chennai. My office is locked by civic authority as a matter of precaution till 5th August. One of my audit staff is also a covid + case Even if I escape from quarantine, still I can’t enter my office

  23. RIDDHI SIDDHI says:

How can be a Tax Bar Association having Chartered Accountants as a Member. CAs are not Members of Bar Council of India as well as State Bar Councils.. than how can they be members, President & office bearer of Tax Bar Association. Only practicing Advocates holding CoP from State Bar Councils can be a member & office bearer of any Bar Association whether Tax Bar Association or District Bar Association.

  24. PRAKASH D SHAH says:

Sir, the Hon’ble CBDT must extend the due date of return of income for Asstt. Year 2020-21, as the utility of return of income has not been made available for certain type of return of income (Utility for three type of return is available) .

People are not able to move from one place to another, no proper transportation. Therefore we request the extention till September 20

  26. pankaj h parekh says:

Extend all due dates of tax compliance IT GST etc. Upto 31st March 21,as the situation is not improving & seems that may not be better in near future. So instead of wasting everyone time on piecemeal extention, extend at a stretch of one year. Declare that any compliance from 14th March 20 till 31st March 21 will not be subjected to late fees or penalty.

  27. Sargam says:

    Sir,
As local trains are not working in Mumbai, peoples are not able to attend the Offices and eventhough they start local trains due to community spread fear how people can travel in train so this year govt should consider the extention of due dates for all types of return. Govt should not give importance to due dates. Because if the C.A. and working staff remain live then only returns can be filed.

  28. Jithendra R Malaviya says:

Also request to extended the GSTR returns for the month of June to Sept 2020 till Nov 30, 2020 due to areawise lockdown.
