Reg: Memorandum on the problems being faced in relation to New Income Tax Portal

Honorable Madam,

While we are proud of Your Honor as our Union Finance Minister for steering our economy so well even amidst & post-Covid difficult financial situation, we would like to bring to your kind notice the problems being faced with respect to the New Income Tax Portal through this Memorandum.

District Taxation Bar Association (Direct Taxes), Ludhiana was formed on 29th day of May, 1981 and for more than 39 years, the Bar Association has been serving to promote the Administration of Law and Justice and to promote up to date knowledge and study of taxation laws amongst the members by arranging seminars, talks and discussions on the subject of Direct Taxes. Our Association would like to invite your considerate intervention for resolving the following issues regarding New Income Tax Portal;

1. The Income Tax Return for the AY 2021-22 cannot be filed through any software or directly by uploading JSON file because this functionality has not been enabled at the Income Tax Portal. Due to this, the Public at large, who are applying for/ renewal of its Bank Loans, for applying tenders to various organization and for applying visa for going abroad etc. are facing lot of problems.

Further, validation errors in Income Tax Return filing utility are not being resolved. Certain information not getting prefilled such as Bank interest and dividend and differences are appearing in TDS information prefilled and that appearing in FORM 26AS.

Further, returns for A.Y. 2021-22 which are uploaded through utility available at the e-filing site are unable to e-verified by the aadhar or any other OTP.

2. The department has still not issued Schema (Electronic Form) of the various Income Tax Return Forms i.e. ITR-2, ITR-3, ITR-5, ITR-6 & ITR-7 even after the passing of 3.5 months of the year.

3. The Electronic Forms i.e. Form 3CA-3CD and form 3CB-3CD for Audit u/s 44AB of the Income Tax Act, 1961 are still not available at the Income Tax Portal.

4. Many Income Tax Returns for the Assessment Year 2020-21 are not being processed. Due to which Income Tax Refunds are pending with the department even after more than 6 months of filing of Income Tax Returns and thereby the assessees are facing Liquidity Issues.

5. The Form No. 15CA and 15CB which are required for remittance of funds out of India have not been enabled at the Income Tax Portal.

6. Digital Signatures of the assessee are not getting properly updated at the Income Tax Portal and is subject to repeated glitches.

7. There is very slow speed of uploading replies/submissions at e-proceeding portal of the e-filing site. Sometimes replies uploaded are not reflected at the Income Tax Portal.

8. Forgot Password facility is not working properly. There is no Forget Password option to reset the password or the option to reset using the DSC as was available. Accounts are getting blocked on entering incorrect password for three times.

9. Income tax returns in response to notices u/s 148 of the Income tax Act, 1961 (Reassessment of Income) is not uploading at the e-filing site. Further, these returns are to be filed within 30 days and 30 days are already over but still the portal is not working.

10. The assessees are not able to file the form no. 35 i.e. regarding filing of appeal before Hon’ble CIT (Appeals) as there are some technical glitches. Either the form is not uploaded at the portal or data already submitted stands deleted. Further, not able to Add authorised representative in Filing of Appeals

11. Already filed appeals which have been partly heard, written submissions of the same are not reflecting at the Portal. Further in some old cases, remand reports are pending and the same are not being reflecting at the Portal. Rather such old Written Submissions are being called time and again.

12. Assesses are not able to download Intimations u/s 143(1) from the income tax portal for any year.

13. Assesses are not able to download receipts of any forms already uploaded at the Income tax site.

14. Old Rectification Applications, u/s 154 which are pending, are not reflecting at the portal.

15. Form 10A and 10B for registration of Charitable Institutions are still not available at Portal.

16. Legal heir of deceased assessee is not able to get himself register for filing of ITR, Submissions or appeal.

17. Applications filed for low deduction u/s 195(2)/197 are not getting reflected at the Income tax Portal.

18. Income tax department (faceless assessment unit) has imposed Penalties in many cases, inspite of the fact of non-working of the Income tax site from 1st June, 2021 onwards.

19. Taxpayers are facing problems in updating their profiles to 100% level due to which the taxpayers are unable to access some of the features of the website.

20. Activation emails remain undelivered in case of Registration of new PAN/TAN on the portal.

21. Facility of Know Your TAN is not properly activated, due to which Trade Name behind the Individual TAN is not traceable for TDS as appearing in 26AS.

Besides the above issues, taxpayers are not able to access old records and also there are other anomalies in past tax records.

Due to the above issues and problems, not only that we are unable to reply to the notices of the Income-tax Department, we are also unable to do compliances for which due dates are fast approaching.

We are very optimistic that your honor will consider our submissions as an appeal from our side and will kindly intervene promptly so that these issues are resolved at the earliest. We have every confidence that our request will be acceded to, when your bighearted attention is with our legitimate problems.

We assure you that we will leave no stone un-turned in complying with our professional obligations quite diligently for the welfare of our beloved Nation, as has always been our prime motive.

    Finally, after 45-60 days, I was able to file ITR2.
    I can say this is one of the Shitty software which is developed. It is a sheer waste of time for all the taxpayers.

    Some of my own experiences and if Infosys can take this as feedback.

    Issues:
    1. Extremely difficult for a layman to use. Please consider the use of the software for laymen. Please consider when someone files the returns, he cannot be an expert in complicated income tax ACT and finance act and intricacies with the provisions of the income-tax act. (Probably difficult for income tax officials by themselves)

    2. Navigation is extremely difficult. Unable to keep track of the changes done on previous screens. Consider the table edits by select of multiple rows whenever possible.

    e.g. TDS entries, Provided a form /table to edit by selecting all rows or multiple rows (similar to xl tool). Today I can’t select all rows or multiple rows to edit. This can be adopted in many places like Foreign Assets declarations, etc,

    3. I am not sure where the data is getting populated for the pre-filled data on ITR-1. When I tried to use the pre-filled data, the TDS entry was incorrectly taken. Not sure what kind of testing is done. Correct all the uploads of the data. Indicates poor quality of the work done by software.

    4. When using the prefilled data for ITR2, the TDS entries, Only one row was populated. Other TDS entries are not filled. We had to manually add other entries. Salary details with Employer name, address, Data do not get populated. The entire data had to be entered manually even with offline tool v1.0.7 (latest as of 8/16)

    5. Validation is successful on the offline tools, when it goes for verification, it throws again multiple errors. So is Validation done offline is incorrect or insufficient. Again poor quality of the offline tool.

    6. Pay Tax for self-assessment on the link does not have a proper link. It goes to an invalid link that does not exist.
    7. I tried login in because the link did not work in the 2.0 portal. I did not find where I can pay the tax from the portal. Finally went to my bank account and paid the self-assessment tax in the tax corner. This indicates poor quality of testing done by the software and absolutely no concern of the taxpayer.

    8. When used to print options at the validation of the returns, saved to the PDF, does not show checkboxes checked clearly. The user cannot identify what is checked. e.g Individual or HUF.

    9. The same print saved as a pdf file , User cannot even search the text.

    10. Overall Navigation is unfriendly and when we confirmed on any schedule screen all the filled data gets collapsed. You are making the TAX-PAYERS to do software TESTING for you.

    10. In Nutshell, the value of man-hours spent is costlier than payment of the Tax.

    MAY GOD SAVE THE TAXPAYERS OF THIS NATION

    For the last one month or so I was trying to file my IT returns of HUF. And always I am getting error messages, like give Bank name; even if it was there. Bank account validation not possible. Even if I have mentioned that it is not prepared by a representative, error is coming as ” PAN of representative and PAN of person uploading are different”. Also in the declaration, I cannot select KARTA, but only representative.
    I don’t know how to overcome this.

    I am also facing issues in ITR3. somehow, it has decided that i am eligible for AMT (actually I am not as there is no relevant deductions) so giving error not matching AMT and deemed income. Irony is that AMT schedule is disabled for me. Also, it is asking me to fill ESR with zero, but if I fill zero, ESR is not saved showing me again error of ESR not filled. Total junk site as grievances are raised for last 10 days, but nobody bothered to look into. Sad affairs from Infosys and not being tracjed by our FM team. Really sad.

    For over 40 days I have been trying to file ITR 2(Individual). Even though it is almost complete, validation does not take place. I do not understand the error messages. There is no indiactionn or suggestion. I feel obligated to file ITR in time. But the new eportal is not functtioning for ITR2. The CA I have contacted says the site is noot ready. No one appears to know when it will be ready.

      40 days of trying to file ITR-2 for me too. I have to repeatedly fill some info that does not get saved. Every time I get the same error message about SI schedule which cannot be edited ( it does not pick up figures from other schedules). Everything is verified for the past month but I cannot file.

      I have repeatedly raised grievances regarding the error messages I am seeing, with the screenshots, but none have been addressed. It took me a day to get my bank information accepted without error messages. Capital gains is not calculated correctly. Tax payer is being made to suffer.

    I just checked the contents of .jason file generated. It is picking valid 7 digit BSR code. Also it is picking correct answer “no” in reply to question “whether you were a partner in a firm”. Lastly enter bank name in schedule part B TTI to which I already said there is no such line in schedule B TTI. It is supposed to pick from assessee’s data. So how validation errors get generated is not clear. It only points to one thing. There is some deeper software issue which infosys is not yet able to resolve. Really unfortunate.

    While filing itr3, I get the following validation errors.
    1. Please enter a valid 7 digit BSR code. I checked. It is 7 digit code. So totally stuck.
    2. Please enter bank name in schedule part B TTI. There is no provision to enter this since software should pick up bank name from bank details in “general” schedule but apparently not pucking it.
    3. It automatically chooses “yes” to query “whether you were a partner in a firm” whereas I had chosen “no”. How no becomes yes is known only to infosys.
    There are quite a few other issues. Does not look like, we will be able to file return by due date. Govt seems to be very content with this development. Perhaps they are dreaming of reaping the bonanza in terms of penalties which will be levied on tax payers. Never seen such indifference. Truly said,”This is a govt with a difference”.

    New portal for filling ITR is not so easy for a common man. It should be more user friendly like earlier one. Saving draft mode is also not there for which repeatedly data are being put.
    Govt should take necessary steps for filling ITR in an easy way.

    ITR-2 that I tried to use, has the following problems
    1. A fee of Rs 5000 is being indiscriminately being added towards late furnishing of return sec 234F
    2. Many schedules have data missing often. e.g., the CG sheet does not offset the gains with brought forward losses and one has to renter all these information each time
    3. It repeatedly warns that FA sheet needs to be entered or confirmed. edit of this page gives error in Country code.
    4. even though advance tax has been correctly paid, it adds interest under 234ABC

    when will all these be corrected? if by being non communicative, what does the IT dept imply? if the dates are passed, and people are unable to file the return, action will be taken against as if it was a negligence and violation of law? its very scary

    I am unable to view 26AS .If anybody can help me ,it will be great help for me. The web site opens with a cat and a lady siting on a coat and there is no head and tale for the site .I don’t know what is the problem. Can the Income tax department revoke the previous site .

    Income tax e-filing website is not working… one clicked on login it take 10 min to load and with
    This site can’t be reachedeportal.incometax.gov.in took too long to respond.
    Try:
    Checking the connection
    Checking the proxy and the firewall
    Running Windows Network Diagnostics
    ERR_CONNECTION_TIMED_OUT

    This is waste of public money and time… Finance min.. need to take action asap..

    I filled the requisite schedules of ITR2 via the official IT Utility. But in the Preview the system shows YES where I ticked NO for Foreign Assets. It does not get corrected despite repeated Edits. This is a major issue and I therefore cannot verify the return with auto NO for a section where I have ticked YES. Repeated complaints for 3 weeks meet with no productive response. No response to email.

    Another glitch is INDIVIDUAL also has HUF auto ticked in Preview, not correctable. Also none of the Bank accounts show Validated even though all are.

    The least FinMin could do is extend ITR filing for AY21-22 indefinitely till the new portal is glitch free and user friendly. Or at least announce a firm date/week when the rectified portal will be ready so that Taxpayers and Professionals do not waste their precious time every day with nothing to show for their efforts except for stress and harassment.

    The website is very slow even in login while we put pan no. It accepts the words at snail speed. On iPad I am not able to fill any column . I suggest that for this year , old software should be reinstalled and on this new software developer should make testing for this year. If this position remains then assesses will not be able to file even ITR1 in the whole year leave the case of other ITRS like 2 and 3. In the software which was earlier used even layman was able to file the returns on his mobile in 2 minutes . Now it has been made an uphill task. We can’t expect such a software from Infosyes. It has repeated the same history which it makes while introducing the new GST software.

    Need help . Unable to everify after submitting the return. OTP was not coming so opted to e=-verify later. But even after 10 days, i am unble to e verify as nothing happens after pressing the button to everify. Any suggestions?the grievance recorded on portal is not attended to.

    I tried filing ITR1 today Everything went well till I reached the taxes paid section TDS as per 26AS is not shown in the section I am supposed to get a refund Instead the section shows amount to be paid as tax Does any else have had similar issues.

    1. Short term capital gains are being taxed at 30%, when they should be taxed at 15%, the special income schedule is not showing stcg.
    2. The calculation of my tax shows that I am eligible for refund because TDS on my salary was more than my liability of tax, still it is applying interest on deferment of advance tax.

    I am of the view that these are also the problems in the new tax filing system and I am not doing something wrong in filing.

      Special schedule is not showing anything under either STCG or LTCG. The tax is not being computed correctly and I cannot verify return until special schedule (which I cannot change) matches my capital gains figure.

    Have filed my ITR1 on 29th. On 29th Portal didn’t show in the filed return. However got the message that e verification has been successfully done. Portal shows filed return date as 30th. Despite best efforts not able to download neither the receipt nor the form. NEVER IMAGINED EVEN MY WILDEST OF DREAM THIS IS THE OUTPUT BY SO CALLED INFOSYS. ROTTEN. BOTH INFOSYS, GOVT.       Thank you Rajeev Kumar for compiling different issues of the new portal. I have sent an email to helpdesk and they are not able to provide any solution except keep on asking me to refresh the browser to resolve the issues. It seems the new portal has several bugs and it is not yet ready for execution. I am frustrated the way things are working right now. I thought the new portal will be user-friendly, but it is a total disappointment as of now. I have even dropped an email to FM. The situation is pathetic.

        While confirming General Information I found that my date of birth is written as one day before that actual date. The profile shows the right date of birth. How can I confirm wrong date of birth when in my profile and PAN the date of birth is correct

          I am facing same issue. My date of birth in ITR1 form is being shown (pre-filled) as 1 day before my actual date of birth. However, the date in “My profile” is correct. There is no way to edit the data in the profile of ITR form

    1. The new portal is also not enabling us to e-verify the returns.
    As and when we click on the e verification tab. It does not redirect to the OTP dialogue box. This issue was not there earlier. This problem has arisen approximately a week ago.

    Is anyone else facing the same problem.

    2. Also we are unable to see the link Adhar and PAN status. After linking the Adhar with PAN we are not able to see status whether it is linked or not.
    This thing in earlier portal used to take less than a hour but here in this portal its been 4 days but still no progress.

    Old portal is far better than the new portal.
    When I tried to fill the ITR 1, some of the values are autopopulated using the form 16. But none of the value is correct. All the income/deductions/tax payable values are twice the actual ones. Ex: If my Annual salary is 10Lakhs, its shown as 20Lakhs. If my 80C savings are 1.5Lakhs, its shown as 3Lakhs. Not sure if I can change them and submit the ITR. But heard that there is no acknowledgment getting generated. All these issue prompting us to support the old portal only rather than the new portal.
    Navigation is too difficult and unable to track the values that’s filled in the previous screens.

    Please bring up the old portal only.

    ITR 2 CAN NOT BE FILED. I HAVE TRIED MANY TIMES BUT EACH TIME IT GIVES STRANGE VALIDATION ERRORS. CAPITAL GAIN IS NORMAL IN EVERY CASE BUT NEW PORTAL IS NOT COMPUTING ANY SCHEDULE PROPERLY. IN HUF RETURN IT IS SAYING THAT THE PAN NO. OF FILER AND AUTHORISED REPRESENTATIVE IS DIFFERENT. THERE IS OBVIOUS PROBLEM AS IN PAN NO. OF AUTHORISED REPRESENTATIVE A ‘/’ IS BEING INSERTED AUOTOMATICALLY BY THE PORTAL. HOPELESS SCENARIO.

    nandan nilekini being a congress man taking revenge on modi govt by making nasty software product to income tax dept. I kindly request our Hon’ble prime minster and finance minister immediately change this company and restore old software which was working super. every day interest and penalty is going up, already due to pandemic people of india suffered lot, they cannot bear this torture. both gst and income tax website proved to be worst software product of the infosys, if any body ask bad software we can show our finger on these two products in future.

INCOME TAX department must switch over to old portal. let them first fix the issues have an in-depth R&D then make it available for public.

    Public Interest Litigation (PIL) in the Hon. Supreme Court is the only solution left. Infosys has once again proved itself to be incompetent at best. The IT Dept is dozing. The site is buggy & only induces frustration. What an utter shame especially since the old site worked like butter.

    With so many issues being faced by various stake holders, request FM to put stop to this new portal & revert to old till all glitches are fully resolved. Being Senior Citizen I don’t have much strength & patience left in me to struggle with the new system. As it is we are battling with the most serious Pandemic of our lives & are at the bottom of our wits. For many years I have been filing my returns myself on line without any problem. Pls ensure same by reverting to old system. Thx

    Tried posting a grievance, the grievance itself has become invisible on the website. Shows blank when submitting grievance number.

    This is the worst software Infosys has ever made, perhaps not made by them. More than 4000 crores of tax payers money has gone down the drain. No one is able to file return of income properly and it is only wastage of time and energy. Almost every schedule is messed up. Worst is their auto population of data. At one place they have rounded up to nearest rupee at other they have left it, so their is mismatch and Return can not be uploaded. This platform is prepared by someone who does not know about various sections on Law and hence has neither been able to provide proper schedule under capital gains, nor under Exemptions. Most useless exercise to correct it. Better this be scraped.

      The new portal is showing up newer problem issues every day.
      Today, on retrieval of the previously filled and saved data, it starts popping up a message that my return is filed and advises me to file a revised return. Whereas I never submitted my return. Further it does show under filed returns too. It is a serious software bug. Infosys cannot shift blame to others for such bugs.
      I also advocate restoration of old portal

    I am Trying from Last 7 to 10 day to register my Clint Pan Card (New Registration), All Details are filled up, and al the final stage i.e. “Secure your Account” tab I set password as per direction and at “Set your Personalized message” set message as per instruction, but complete the submission after repeatedly click on Register button (Registration button also active).
    Please solve the Problem.

    Old bank a/c SBBJ now merged in SBI. SBI a/c is validated but old SBBJ A/C shows validation in progress. This SBBJ a/c is not removing. I nominated New SBI a/c for refund in profile bank a/c section. But in e-filing process automatically Old SBBJ a/c is showing. No option is show to choose New a/c .
