The Department of Legal Affairs, Ministry of Law & Justice has invited applications for the posts of Judicial Members and Accountant Members in the Income Tax Appellate Tribunal. There are 22 vacancies for the post of Judicial Member while there are 13 vacancies for the post of Accountant Member.

**Out of 11 current vacancies of Accountant Member, one vacancy is reserved for a person who is Orthopaedically Handicapped. Orthopaedically handicapped persons with the following disabilities will be considered for appointment, subject to production of medical certificate and medical examination by the appropriate Medical Board.

2. The number of vacancies indicated above is only approximate and is liable to increase due to unexpected circumstances that may occur upto 3 1. 12.02010.

3. The posts belong to General Central Services Group ‘A’ (Gazetted) and carry a pay-scale of Rs. 22400-600-26000/- (per revised) plus other allowances as admissible under the rules. The posts are temporary at present, but are likely to continue.

4. Candidate already in service and entitled to pension will continue to enjoy the same benefits.

5. QUALIFICATIONS:-

(a) JUDICIAL MEMBER:- A person shall not be qualified for appointment as a judicial member unless:- (i) he has for at least ten years held a judicial office in the territory of India; or (ii) he has been a Member of the Indian Legal Service and has held a post in Grade-II of the service or any equivalent or higher post for at least three years; or (iii) he has been an advocate for at least ten years.

Explanation for the purpose of (a) above:

(i) In computing the period during which a person has held judicial office in the territory of India, there shall be included any period, after he has held any judicial office, during which the person has been an advocate or has held any post, under the Union or a State, requiring special knowledge of law;

(ii) In computing the period during which a person has been an advocate, there shall be included any period during which the person has held judicial office or the office of a member of a tribunal or any post, under the union or a State, requiring special knowledge of law after he became an advocate.

(b) ACCOUNTANT MEMBER: A person shall not be qualified for appointment as an accountant member unless; (i) he has for at least ten years been in the practice of accountancy (a) as a charted accountant under the Charted Accountants Act, 1949 (38 of 1949; or (b) as a registered accountant under any law formerly in force; or (c) partly as such registered accountant and partly as such accountant; or (ii) he has been a member of the Indian Income Tax Service Group ‘A’ and has held the post of Additional Commissioner of Income Tax or any equivalent or higher post for at least three years.

    All these comments remind me a news item published in a paper long time back that the top brass in the ITAT itself was under the scanner by the CBI after the CA and the Member of Calcutta ITAT were caught red handed. I also remember that the drafts of ITAT’s orders made in floppies/CDs and payment for services rendered are both handed over to the presiding member. And this is the practice too, accepted all over in the country in all benches. I also know that the two members in a particular bench in the south were always fighting-one was corrupt and the other reasonably honest. And that dishonest member used to openly declare that he paid huge amount for becoming member so he could do anything, so much so that he went against an earlier decision of the same bench in a similiar case of the same group only because of non-payment of his dues. The same member also told one appellant, already bankrupt, to sell his only house to pay his dues and otherwise to be prepared to lose the case. The poor man had no money, the house was mortgaged. So he lost and his representative kept on losing cases after that. The son in law of restaurant owners also become members, while not much work is there. No vehicles, no telephones, no stenos. Of course stenos are not necessary as orders are typed either by a colluding DR or a cooperative CA/Adv. But the mystery is the cause of this latest ad calling for applications. What is the going rate now?
    The CVC and the CBI will definitely know.

    This is a very misleading news, almost verging on disinformation. There is so much corruption in this 65 years old organisation, and so meagre workload due to the all-pervading competiotion to make money, that it has become public knowledge as to how memberships are available. Recently, an order of transfer of a VP of one Bench to another Bench has had to be rescinded due to CBI’s objections to that VP’s relocation. It is not known as to what is the Honorable President’s reaction. In another case, one member has been transferred from one Bench to another at his own request. So the Honorable President passed his transfer order with the rider that the member will not be entitled to any TA/DA, but at the same time the Honorable President also ordered that very member to go on “Camp” to the new station so that the rider as said (no TA/DA) becomes totally irrelevant. Is the CBI looking into this also along with the Kolkata bribe episode? And, in this view of the affairs of the ITAT, is there really any need for employing new members, unless of course there is any ulterior pecuniary motive ?
    I think, the Law Minister and the Parliament, as well as the CVC, should consider these aspects.

    This is again ludicrous indeed,since what is widely believed is that, there is hardly any workload even for the existing members on roll. There are hardly enough number of cars, office space, supporting staff, etc.
    Is there really any need for more members?
