Faruk Alam Vs State of Assam (Gauhati High Court)
The Court proceedings have been conducted through Video-Conference due to COVID-19 pandemic.
Heard Mr. SN Nath, learned counsel for the petitioner. Also heard Mr. BB Gogoi, learned Additional Public Prosecutor appearing for the State respondent. This is an application, filed under Section 438 of the Cr.PC. seeking pre-arrest bail of the petitioner, namely, Md. Faruk Alam, in connection with Abhayapuri P.S. Case No. 456/2021 registered under Sections 379/468/420/411 of the IPC.
Perused the case diary produced before this Court.
It appears from the materials in the case diary that the coal loaded truck was seized by the Police which was kept at the place of occurrence by the accused-petitioner and his co-accused. They are not co-operating with the investigation of the case, rather they are avoiding apprehension by the Police.
Considering the fact that such cases of coal theft and carrying coals without GST, etc have become so common that unless such offences are thoroughly investigated, it will cause huge loss to the State exchequer. To unearth the fact of the case and to see the nature of involvement of the petitioner, custodial interrogation is necessary.
Therefore, prayer for pre-arrest bail of the petitioner stands rejected.
