Public Notice No. 6 (RE-2002)/2002-07, dated 12th April 2002, issued by the Ministry of Commerce, introduces corrections to the “Schedule of DEPB Rates” under the Export and Import Policy, 2002-07. The notice revises General Instructions for DEPB rates, specifying that DEPB rates do not apply to certain exports, such as those manufactured in free trade zones, or exports under schemes like DFRC or Advance License. Additionally, the Product Group “Chemicals” has been updated with new DEPB rates for specific items, including ceramic glazed floor tiles (14.00), various types of paper (6.00), and optical brighteners (7.00). The notice also deletes an existing entry (S.No. 665) under the Chemicals product group. Two new items, automobile tubeless tyres (13.00) and N-Oxydiethylene Benzothiazole Sulfenamide (10.00), are added to the Chemicals group. These changes, effective from 12th April 2002, are aimed at ensuring clarity in the application of export benefits under the relevant EXIM Policy provisions.

In exercise of powers conferred under paragraph 2.4 of the Export and Import Policy, 2002-07 and paragraph 1.1 of the Handbook (Vol.1), the Director General of Foreign Trade hereby makes the following corrections in the “Schedule of DEPB Rates” as under:-

1. S.No. 1 of General Instructions for DEPB Rates shall be corrected to read as under:-

1. The rates of DEPB specified in book shall not be applicable to export of a commodity or product if such commodity or product is:-
a) Manufactured partly or wholly in a warehouse under Section 65 of the Customs Act, 1962 (52 of 1962)

b) Manufactured and/or exported in discharge of export obligation against an Advance Licence including Advance Licence for Annual Requirement or exported under DFRC Scheme of the relevant EXIM Policy.

c) Manufactured and/or exported by a unit licenced as hundred percent export oriented unit in terms of the provisions of the relevant import and export Policy;

d) Manufactured and/or exported by any of the units situated in free trade zones /Export Processing Zone/ Special Economic Zones / EHTP Scheme;

e) Exports of goods of foreign origin, unless the goods have been manufactured or reprocessed or on which similar operations have been carried out in India.

f) Exports made under paragraph 2.35 and 2.36 of the EXIM Policy.

2. The following corrections shall be made in the Product Group – Chemicals (Product Code-62).
