Public Notice No. 16 (RE-00)/1997-2002, issued by the Government of India on June 30, 2000, introduces amendments under the Export and Import Policy 1997-2002. It specifically addresses the re-export of goods imported under the DEPB (Duty Entitlement Passbook) scheme. Goods found defective or unfit for use can be re-exported, with 98% of the DEPB credit amount generated by the Customs Commissioner. This amount, along with details of the original DEPB, enables the issuance of a fresh DEPB with the same port of registration and validity. Additionally, amendments are made to Chapter 10, correcting and updating DEPB entries for various product groups such as engineering, chemicals, and textiles. Notable changes include value caps for DEPB entitlement and corrections to product descriptions for several textile and chemical products. The notice also updates details regarding authorized agencies, including a new agency in Punjab for issuing non-preferential certificates of origin. Lastly, a corrigendum deletes an entry from Public Notice No. 14, dated June 8, 2000.

In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II-Section 3 – Sub- section (ii) vide S.O.No.283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol.1). (RE-00), 1997-2002.
1. The following shall be added as paragraph 7.50A
7.50A Re-export of goods imported under DEPB scheme | Goods imported under DEPB scheme, which are found defective or unfit for use, may be re-exported, as per the guidelines issued by the Department of Revenue. In such cases 98% of the credit amount debited against DEPB for the export of such goods, shall be generated by the concerned Commissioner of Customs in the form of a Certificate, containing the amount generated and the details of the original DEPB. Based on the Certificate , a fresh DEPB shall be issued by the concerned Licensing Authority. The fresh DEPB, so issued, shall have the same port of registration and shall be valid for a period equivalent to the balance period of validity of the DEPB against which such goods were imported |
2. The following amendments shall be made in Chapter 10:
(a) The first sentence of Paragraph 10.15 (ii) shall be amended to read as under:
“ The claim shall be filed against payment certificate received on monthly basis/quarterly basis/half yearly basis , except for supplies under paragraph 10.2 (d),(e),(f) and (g) , where it may be filed either on the basis of payment certificate or on the basis of proof of supplies effected.”
(b) The second sentence , beginning at the fifth line, of the Paragraph 10.15(ii) shall be deleted.
3. The following amendment shall be made in Appendix 28A-
Product Group: Engineering (Product Code:61)
(i) The value cap for DEPB entitlement as given in col.4 of the above Appendix shall be amended in respect of the following items as indicated against their respective entry numbers.

(iii) Description of the export product at Sl.No. 72 shall be corrected to read as under :
“ All processed Cotton madeups including quilted cotton madeups, with or without embroidery and/or with or without metallised yarn and not covered under Sl.No.69”.
(iv) The following new DEPB entries shall be added after Sl.No.79

(vi) The DEPB entry Sl No.46 shall be amended to read as Sl.No.46(a).
(vii) The following new entries shall be added at Sl.Nos. 44(c) & 46(b)
