PUBLIC NOTICE NO. 11 (RE-01)/ 1997-2002

In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997-2002, as notified in the Gazette of India extraordinary, Part-II Section 3, Sub section (ii) vide S.O. No.283(E) dated 31.03.1997, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol 1).(RE-01), 1997-2002.

1) The heading of paragraph 5.30 would be amended to “ Restricted Items Licence”

2) The last sub paragraph of paragraph 6.11 shall be amended to read as :

“However, the licences issued under the scheme upto 31.03.2000 shall be governed by provisions laid down in paragraph 6.11 as given in Handbook (Vol 1) (RE-99). Notwithstanding the provisions in Handbook (Vol 1) (RE-99), the licence holder will not have to surrender SIL in cases of valuewise shortfall .”

3) Paragraph 6.13 (c) (i) is amended as under:

Consolidated statement or individual statements (bank/ authorized dealerwise) of services or rendered in the form given in Appendix 10 D, duly certified by a Chartered Accountant and Bank(s) / authorized dealer(s) evidencing foreign exchange earnings received through normal banking channel.

4) Paragraph 7.8 (a) would be amended as under:

(a) It may be allowed only when the total cost of power constitutes not less than 10% of the total cost of manufacture of the export product. The cost of manufacture would be the ex-factory value of production of the resultant product.”

5) The following shall be added at the end of paragraph 7.38 (v) :

However there would be no need for monitoring of exports/ shipment made under an irrevocable letter of credit.”

6) The first sentence of paragraph 7.54 shall be amended as under:

“ Manufacturer exporter with export performance or total turnover (in the case of annual advance licence for deemed exports and intermediate supplies only) of Rs 1 crore in the preceding licencing year and registered with excise authorities, except for products which are not excisable for which no such registration is required, shall be entitled for such licences. .

7) The last two sentences of paragraph 7.57 are corrected as follows:

“ The CIF value of DFRC shall be arrived at after discounting 25% from the FOB value of exports. The FOB value shall be calculated on the basis of the bank realization certificate.”

8) The last sentence of paragraph 10.11 stands amended as under:

“ The domestic supplier shall be eligible for the benefits given in paragraph 10.3 (a) and (b) of the policy.”

9) Sub paragraph 2 of paragraph 10.12 stands deleted.

10) The first sub-paragraph of paragraph 11.2 is amended as under:-

An application for grant of export licence in respect of items mentioned in Schedule 2 of ITC(HS) may be made in the form given in Appendix-18A or 18B, as the case may be, to the Director General of Foreign Trade and shall be accompanied by the documents prescribed therein. A committee shall consider applications on merits ofr issue of export licences.

11) The words and expression “SIL” stands deleted from paragraph 15.3.

12) A row would be inserted in the table of Statement of Export at S.No 7 and 8 in Appendix 19 as under:
