Notification No. 3 (RE-2005)/2004-2009, dated 17th May 2005, issued by the Ministry of Commerce and Industry, announces amendments to the Foreign Trade Policy, 2004-2009. The amendments include changes to multiple sections of the policy. In sub-para 4.1.11, the policy now allows supplies from Special Economic Zones (SEZ) to be obtained against a license, without conversion into ARO, aligning with other export-oriented units like EOU, EHTP, BTP, and STP. Sub-para 6.6(d) introduces a provision for the Board of Approvals (BOA) to fix sector-wise investment criteria. Para 8.3(a) clarifies the inclusion of Advance License and DFRC (Duty Free Replenishment Certificates) under the policy. Lastly, sub-para 8.4.4(v) adds a new provision stating that suppliers are eligible for benefits outlined in paragraphs 8.3(a) and 8.3(b), depending on the situation. These amendments aim to streamline the procedures and enhance clarity for businesses engaging in export and import activities. The changes are issued in the public interest.

NOTIFICATION No. 3 (RE-2005)/2004-2009

NEW DELHI, DATED THE 17th May, 2005

S.O.(E) In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 read with paragraph 1.3 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes the following amendments in the Foreign Trade Policy, 2004-2009:

1. In sub-para 4.1.11, the sentence “However, supplies may be obtained against the licence from EOU/EHTP/BTP/STP/ units, without conversion into ARO “ shall be amended to read as “However, supplies may be obtained against the licence from EOU/EHTP/BTP/STP/ SEZ units, without conversion into ARO.”

2. At the end of sub-para 6.6(d), the following sentence shall be added :-

“ Sector-vise investment criteria shall be fixed by BOA.”

3. Para 8.3(a) shall be amended as under :

(a) Advance licence/DFRC”

4. At the end of sub-para 8.4.4 (v), the following shall be added :

“The supplier shall be eligible for benefits listed in paragraph 8.3(a) and (b) of the Policy, whichever is applicable.”
