CBIC exempt imports of Yellow Peas [HS 0713 10 10] from applicable BCD and AIDC up to 31.03.2024 vide Notification No. 64/2023-Customs | Dated: 7th December, 2023.

Introduction: The Ministry of Finance, through Notification No. 64/2023-Customs, dated December 7, 2023, has granted a significant exemption for the import of Yellow Peas [HS 0713 10 10]. This exemption, effective from December 8, 2023, to March 31, 2024, is a noteworthy development aimed at promoting specific economic interests.

Detailed Analysis:

1. Legal Foundation: The Customs Notification relies on the authority vested in the Central Government by the Customs Act, 1962, and the Finance Act, 2021. Section 25 of the Customs Act, 1962, empowers the government to issue such notifications for public interest.

2. Exemption Scope: The notification exempts Yellow Peas from customs duty and the Agriculture Infrastructure and Development Cess (AIDC) when imported into India. The specific tariff item mentioned is 0713 10 10, covering Yellow Peas.

3. Duration of Exemption: The exemption is time-bound, starting from December 8, 2023, and extending until March 31, 2024. This temporal limitation implies that importers will enjoy relief only during this stipulated period.

4. Public Interest Consideration: The government, in exercising this power, expresses satisfaction that such an exemption is necessary in the public interest. The rationale behind this decision remains a subject of scrutiny and could be linked to economic, agricultural, or trade considerations.

5. Administrative Implications: Importers and stakeholders must adapt their strategies in light of this exemption. Customs clearance procedures, documentation, and financial planning need adjustment to align with the altered duty landscape for Yellow Peas during the exemption period.

6. Agriculture Sector Impact: Given that Yellow Peas are a significant agricultural commodity, the exemption may have implications for domestic farmers, traders, and related industries.

Conclusion: The Customs Notification No. 64/2023-Customs, providing an exemption for Yellow Peas imports until March 31, 2024, marks a strategic move by the government.
